Judge Tells Illegal Alien He is "Unwelcome Undesirable"

General Sessions Court Judge Bob Moon said the man charged with setting a fire in a downtown hotel is "an unwelcome undesirable" illegal alien.

Judge Moon told Bario Gomez, "Undesirables like you are not welcome in this country. You are a Latino terrorist who entered this country illegally and soon plotted significant personal injury and damage to the people and businesses in our community."

Authorities said Gomez is an illegal alien with no proof of identification. Officials also said he gave police a false name.

The INS placed a hold on Gomez, 20, after charges of aggravated arson and aggravated vandalism were filed against him.

Judge Moon told him, "It is undesirables like you who create many unjustifiable problems and prejudices upon the good people who enter this country legally in chasing a dream for a better life for themselves and their families.

"Mr. Gomez, you nor any other citizen from a foreign land has a right to enter this country; you simply have a privilege to enter this country through the proper legal channels.

"You are a domestic terrorist who is an imminent threat to the safety of our people and their property. You are also a supreme flight risk from justice. It is with duty, comfort and ease that I increase your bond significantly in an appropriate amount to insure your appearance in further proceedings and to insure the safety of this community."

The bond was raised from $30,000 to $1 million. The previous bond was set by Magistrate James Purple, which Judge Moon described as "another ludicrously low bond."

According to Arson Investigator James Whitmire, Gomez checked into the hotel with his girlfriend. Testimony by Whitmire and management officials indicated that Gomez placed a toaster filled with matches in a microwave oven in his room intending a massive "delayed burn."

Proof also showed that multiple towels were stuffed into the toilet in order to retard the water supply. The hotel manager testified that the towels were stuffed so deeply that the pipes had to be disassembled to remove them. She also stated that the room was severely damaged and vandalized.

Capt. Whitmire testified that "hundreds of people were evacuated, including children."

He said, "If the fire had established itself many families and children would have most likely lost their lives or been severely injured. Being on the fourth floor, the fire would have been difficult to contain."

CAMDEN COUNTY - Two men are being held for deportation after threatening a Sunrise Beach resident.

On Tuesday at approximately 4:30 p.m., the Camden County Sheriff's Department responded to a call of a reported assault in Sunrise Beach.

When deputies arrived, the female victim said she had been assaulted by two Hispanic men who she said also threatened her if she called authorities.

Jose Paniagua Avalos, 19, and Jose Guadalupe Delacruz, 26, had fled the scene before deputies arrived.

According to the sheriff's department, a neighbor of the victim who had witnessed the assault had forced the men to leave by threatening them with a baseball bat.

Deputies were able to locate the men a short time later and took them into custody without incident.

Avalos is being held on one count of third-degree assault and a federal hold from U.S. Immigration and Customs Enforcement, while Delacruz is being held on a warrant from Jackson County, Mo., charging him with driving with a revoked license. He also is being held for ICE.

Both men are originally from Mexico but, until yesterday had been living in Sunrise Beach.

Suspect Pleads Not Guilty in New Jersey Students' Execution-Style Deaths

NEWARK, N.J. — A Peruvian national in the U.S. illegally and who was previously charged with raping a 5-year-old girl pleaded not guilty Friday in the execution-style slayings of three young college students, a day after he surrendered to the Newark mayor.

Jose Carranza, 28, aka Jose La Chira, entered his plea before Essex County Superior Court Judge Michael Casale. A second suspect, a 15-year-old boy, has been held pending a detention hearing, and authorities said more arrests were "imminent."

Carranza, of Peru, was being held on $1 million bail. He turned himself in to Newark Mayor Cory Booker after his fingerprints were lifted from a bottle in connection with the shootings of four college students on Saturday. Three were killed but a fourth survived and was hospitalized after the shootings in a Newark schoolyard.

FOX News has learned Carranza, who has a fake Social Security number, had been arrested on charges of raping a 5-year-old girl and then threatening the child and her parents. In that case he faced a 31-count indictment.

In another, he was arrested on assault charges stemming from a bar fight.

Immigration officials apparently were aware of Carranza's illegal status since his prior arrests, according to Essex County Sheriff Armando Fontoura.

Relatives of the victims embraced each other as they entered to watch the hearing.

Carranza's attorney, Felix Montalvo, called Booker on Thursday to arrange his surrender.

“He said, ‘Mr. Mayor, we’d like him to be turned in directly to you,’” Booker said Montalvo, who also is a close friend, told him.

On Wednesday night, police arrested the 15-year-old boy who along with Carranza is accused of murder, attempted murder, robbery, weapons offenses and conspiracy to commit the crime of robbery, Essex County Prosecutor Paula Dow said. Authorities were seeking to have the minor tried as an adult.

Dow said she doesn't believe there is any familial relationship between the two in custody.

The teen, who is Hispanic, is an American citizen with a Newark address, Booker said.

“I don’t think words can describe the level of emotion I feel,” he said of the crimes.

“We will confirm that there are others we are looking for," he said, adding, "I am confident all the suspects in this investigation will be apprehended."

Carranza's attorney, Montalvo, led him by the hand during his surrender.

“He simply came forward," Booker said. "He said nothing. We put him in handcuffs."

The sole survivor of Saturday night's shootings, 19-year-old Natasha Aeriel, provided information from her hospital bed after being shot in the head.

Aeriel was with her brother, Terrance Aeriel, 18; Dashon Harvey, 20; and Iofemi Hightower, 20, who were forced to kneel against a wall and were shot execution-style outside a Newark school.

The students had been planning to attend Delaware State University.

Albertville Police Arrest 3 in Prostitution Sting

A 4 month long investigation in Albertville has led to three arrests, and the breakup of a suspected prostitution ring.
Authorities raided the Greenwood Village Trailer Park Tuesday afternoon, and arrested Leida Zapata, Olga Martel-Carrera and Francisco Perez (pictured). The two women are charged with prostitution. Perez faces charges of promoting prostitution. More than one thousand dollars in cash was seized during the raids. Immigration officials have been called in to assist in the investigation.

STUART, Fla. – This South Florida community some 90 miles north of Miami is outraged after a suspected illegal alien allegedly raped a puppy.
The man, who initially told police his name was Junio Trenta but is believed to be Enrique Garcia, was taken into custody after Martin County Sheriff's deputies were dispatched to a possible animal in distress.
When they arrived, officers "saw Garcia sexually assaulting a 28-pound, 14- to 16-week-old dog of mixed breed," according to the sheriffs office. Upon being seen, the Mexican transient said, "It's my dog," and, "What's the problem?"
The arrest affidavit indicates the male dog ran and hid behind the deputies.
Garcia then talked with detectives and admitted only to having the dog in his lap.
He's now charged with sexual bestiality, animal cruelty, possession of drug paraphernalia, giving a false name and exposure of sexual organs. His bond is $13,000.
The dog, a 4-month-old Argentine Dogo, is reportedly being cared for by the Humane Society of the Treasure Coast.
"He's already been evaluated by the vet, and the vet says he's OK and will recover from whatever happened," Humane Society spokeswoman Roberta Synal told the Stuart News. "If he's put in a good foster home, he's going to get lots of love and training." In the newspaper's online messageboard, people are commenting on the case, lashing out at the Mexican who also spent 28 days in jail after pleading no contest to a misdemeanor larceny charge last year in Orange County, Fla.:
"This is the kind of scum that is sneaking into our country with all the 'nice people who just want a better life.' Get real. Send all illegals home, then screen them to see if they qualify to come into America! ... We do not need illegals for anything. (It's all propaganda). Especially, when they think it's OK to do stuff like this. [Garcia] should do everyone a favor, and commit suicide." (Kurt Ploszay)

MARKO BOSKIC, WAR CRIMINAL

Let's call this case a variation on a theme: here is a well known accused war criminal, Marko Boskic, who entered the United States illegally by claiming refugee status and using his own name in 2000 with no problem. The man who has been residing in Peabody, Massachusetts, is believed to be a member of a notorious execution group within the Bosnian Serb Army which killed 1200 Bosnian Muslim men in 1995. According to testimony at the Slobodan Milosevic trial in 2003, Boskic was one of eight soldiers who lined up men in Pilaca and executed them as part of the genocidal scheme of ethnic cleansing in the former Yugoslavia. Furthermore, it's not like Boskic was keeping a low profile. He had numerous arrests for drunk driving and assaults, but no one in local police checked up on his background. Only a tip to federal authorities led to an investigation of what Boskic was really about. Because of a "loophole" in immigration policy, the feds normally track only Nazi-era human rights violators. Boskic's part in the war crimes was described in a front page article in the Boston Globe in 1996, in addition to how he had threatened the reporter, the late Elizabeth Neuffer. After she tracked him down in Bosnia that year and asked him whether he had been ordered to kill the captives, Boskic responded, "Would you like to get whacked?" Update: September 30, 2004, Boskic was indicted for immigration fraud because he portrayed himself an an innocent refugee when he was actually a vicious war criminal.

AHMED HASSAN AL-UQAILY (JIHAD, ANYONE?)

Ahmed Hassan Al-Uqaily, a resident of Nashville, told an acquaintance he wanted to "go Jihad" because he was unhappy about the war in Iraq, his home country. He was arrested Oct. 7 after paying $1,000 for the purchase of two disassembled machine guns, four disassembled hand grenades and hundreds of rounds of ammunition from a federal agent, so he was serious about murdering and blowing up. He also was interested in procuring handguns and missiles. According to the affadavit, Al-Uqaily expressed anger toward Jews and discussed Jewish facilities in Nashville, although he made no threats against specific sites. The video here notes the remark that this was "an arrest that could have saved lives." This terrorist sounds like a random jihadist, rather than someone wired in to larger groups of sleeper cells; otherwise he would likely have easier access to weapons. But this case brings up the obvious question: why do we allow the continued immigration of potential enemies? Al Uqaily was caught because an old friend ran into him and didn't like what he heard, and the friend then became an informant. It was only luck that the would-be terrorist was arrested. Udate, 6/1/05: al Uqaily pleads guilty to illegal possession of weapons. Sentencing is scheduled for October 24, and he may receive between 4 and 10 years in prison. Despite his humble employment at a doughnut shop, al Uqaily had $43,000 in his bank account. Some doughnuts.

AUGUSTINE BRECEDA WANTED JUDGE TO HAVE A HEART

Augustine Breceda was sentenced Oct. 26 to 216 years in prison for nine felony convictions in his violent 25-day armed robbery spree in Reno. The twice-deported Mexican used the opportunity to plead for mercy, whining to the judge, "I just wish you would find it in your heart to give me a release date where I'll still be able to be with my three children who I miss so much." Actually, this perp is just the sort who should be locked up permanently. He likes to rob little old ladies and carjacked a 72-year-old woman near the church where she volunteered. When police officers found him in the stolen car, he tried to hit pursuing officers and caused several accidents as he sped through traffic at 80 mph. After crashing into a phone pole, Breceda broke into a woman's home, although she was able to escape. When Breceda finally was captured, he identified himself as a cousin who lives in Reno. Augustine Breceda already was a six-time felon in California.

SAN DIEGO, CA. Photographer John Monti, was violently attacked and robbed on Saturday, November 18, 2006 at 11am on Rancho Penasquitos Blvd. under the Route 56 overpass where dozens of day laborers gather each morning to illegally solicit work. He had been taking pictures of the day laborers to show how employers illegally employing them perpetuate a large camp of illegal squatters between Rancho Penasquitos Blvd and Black Mountain Rd. on Route 56.
A witness said 8 men jumped Monti from behind, knocked him to the ground, stole his camera and cell phone, and attempted to get away. Monti chased down the migrants who took his gear and a fight ensued. Monti was able to recover his camera and phone. Police responded and are now looking for 8 suspects for assault, battery, and robbery. SDPD’s Northern Division is investigating this attack as a hate crime and can provide more details of the attack. Two local news crews also stopped by soon after to interview a bloodied Mr. Monti.
The San Diego Minutemen have seen a drastic increase in violence among day laborers, most of whom are illegal immigrants. This is the third documented attack in San Diego County in the past two months. SDMM urgently calls on Mike Unzueta, head of ICE in San Diego to immediately resume sweeps of these public sites to remove dangerous criminals that are hiding in plain sight and terrorizing citizens all over San Diego County.
“The increase in hate crimes in San Diego County by illegal immigrants against American citizens over the past few months is alarming. The federal government must take immediate action to enforce immigration laws against criminals that are in the United States illegally”, stated Jeff Schwilk, founder of the San Diego Minutemen.

Hate crimes in northern Los Angeles County surged nearly 45 percent last year, fueled by anti-immigrant sentiment, white supremacist activity and racial tension in schools, jails and neighborhoods, officials said Thursday.
Bucking national and statewide trends - and reversing three years of declines - the number of hate crimes countywide hit 633, with about half involving violence, according to the report by the county’s Human Relations Commission.
North county communities - including Lancaster, Palmdale and Santa Clarita - reported 75 crimes, up from 52 in 2004, statistics show.
Much of the countywide increase was driven by hate crimes against blacks, which rose 47 percent - from 156 to 230 - while anti-Latino incidents surged 179 percent - from 19 to 53. Specifically anti-Mexican crimes rose 71 percent, from 41 to 70.
In contrast, the number of hate crimes statewide dropped 6 percent last year and the number nationwide dropped 8 percent.
“We see additional evidence of the tension between the (Latino and black) communities in the widespread occurrence of brawls in the county jails, juvenile detention facilities and public schools,” said Robin Toma, executive director of the county’s
Human Relations Commission.
The data showed that gang members were responsible for five of the six hate-motivated attempted murders last year. Nearly 80 percent of the racially motivated crimes involved mostly Latino gangs targeting blacks without provocation, authors of the report said.
In addition to racial violence spilling out of the jails and juvenile halls onto the streets, the report found a disturbing escalation in racial hate crimes on or near school campuses.
Racial crimes at schools more than tripled, from 18 to 64. Most involved conflicts between blacks and Latinos, primarily in South Los Angeles, but some also took place at Sylmar and North Hollywood high schools.
“I’m not happy to see there is an increase in ethnic hate crimes involving African-Americans and Latinos,” county Supervisor Yvonne B. Burke said. “The only way we are going to stop this is to get to the core of some of the feelings behind this.”…..

VICTORVILLE — Racially motivated violence between black and Hispanic students at Silverado High School is overflowing from the campus onto the neighboring streets.
Principal Tracy Marsh said that although there’s been a decrease of major issues on the campus this year, the conflicts are alive and well — and finding their way to the streets after school.
“As we stop problems on the campus, where are they going to go? They go off campus, and we see them from a distance and wonder, ‘What do we do here guys?’ ” Marsh said. “My heart goes out to the residents there. I’m sure it’s not something they thought about when they bought their house.”
The problem is racial and stems from a small group of about 75 students, Marsh said.
“I’ll be doggone if I’m going to let these 75 kids mess things up for us. If we could just tap them and get rid of them, then the issues would be gone,” Marsh said. “We know who they are. When the opportunity comes, they’re out of here.”
Jason Dougherty, a Cobalt Road resident, lives two blocks from the school. He said for about 45 minutes a day his neighborhood shifts from a quiet existence to a war zone.
“We become infested with gang-bangers. We’ve seen brutal fights and total disregard for our homes, cars and families,” Dougherty said. “It’s like something straight out of South Central.”
Cindi Jamison, also a Cobalt Road resident, said she has seen cars get keyed and spit on, lawns get trampled and figurines smashed. Her husband has broken up fights, stopped older students from trying to steal the bikes of younger students at neighboring schools and the couple have woken up to find graffiti on cement walls on more than one occasion.
Unfortunately, Marsh said, there’s not much school officials can do. Once the students are off campus, they are out of the school’s jurisdiction. He said when dealing with 3,600 students being let out of school at one time, there is no quick fix. Letting smaller groups or grades out at different times is not an option but they are working with local agencies.
He has requested a stronger presence of law enforcement and said the Citizens on Patrol are also policing the area.
Marsh said the problem is one facing our society as a whole, not just Silverado.
“It’s happening at the mall ... in the neighborhoods. It’s happening all over. They’re fighting in the community on a Saturday and on Sunday,” Marsh said. “It’s not fair to say it’s a school issue.”

SIMIO HAD ALL KINDS OF CHANCES TO STEAL

The story of gang-banger Simio, told in the book True Tales from Another Mexico, is instructive to those who wonder about the Mexican gangsters on American streets and how they came to get here. He made the common immigrant pilgrimage from Michoacan to the United States, but Simio did not come here to work, but to rob. Upon arriving in a nondescript Los Angeles suburb, his reaction was, "I saw there were all kinds of chances to steal." He also discovered crack while in the US, which was a good fit with his chosen profession of thief. His normal routine was to rob two houses during the day and one at night which fed his thousand-dollar-a-day drug habit. He returned to Mexico after three months in juvenile detention with exhortations for the homeboys to get more serious about their gangstering. "I woke those boys up," Simio reported. "They were all asleep. They didn't have the urge to rob. They weren't stealing anything." In time, some of those young men would make the journey to America, already trained in thievery, drug use and gang behavior.

ROBERT BRYANT & ELDERLY MAN INJURED

Denver police officer Robert Bryant was struck down in a hit-and-run as he was flagging down speeders near a school at around 3 in the afternoon January 22. There were numerous witnesses who said the driver gunned the engine of his Chevy S-10 pickup and purposely ran down Bryant, who was wearing a bright orange vest. The driver, a Mexican with no identification, was caught when he ran a red light a few blocks away and crashed into a car driven by an elderly man, who was also injured. Officer Bryant received serious injuries including a femur fracture but is expected to recover. Those who saw the incident say it is a miracle that he wasn't killed The Mexican driver apparently was drunk or on drugs, according to investigators and was injured in the crash.

ANA CERNA KILLED, 4 OTHER CHILDREN & 1 ADULT INJURED

January 2002, five-year-old Ana Cerna was another tragic death at the hands of a irresponsible illegal alien. The girl was one of five children and one adult hit by the car driven by Osvaldo Urzua, a Mexican living in Oakland, California. Ana died after being taken off life support; she had attended kindergarten. Urzua sped away from the crime scene because he feared being deported and expressed no interest in what had happened to the children he struck. On July 15, 2002, he was ordered to spend six years in prison, a disappointingly short sentence for the families of the victims. People like Osvaldo Urzua have created California's hit-and-run crisis resulting from the state being home to so many illegal alien drivers. The state's number of hit-and-run accidents has been accelerating, and is more than twice the national average for percentage of traffic accidents where the driver leaves the scene, i.e. 7.8 percent of the state's fatal crashes in 2001 compared with the 3.8 percent nationally. Since unlicensed drivers involved in fatal crashes may be deported, they are highly motivated not to be caught. As California Highway Patrol spokesman Steve Kohler remarked, someone who runs from an accident is "a person who may feel like they have nothing to lose." An illegal alien criminal would indeed qualify as someone with zero connection with the American community and nothing to lose. GENTLE SONG

Killing a horse is certainly insignificant in comparison with many of the crimes noted here. But the senseless cruelty of killing a beautiful animal as some sort of sick fun shouldn't be overlooked either. "This was an especially horrific and wanton killing," according to Sonoma County Prosecutor James Patrick Casey. Gentle Song was a thoroughbred mare that was the beloved pet of a 13-year-old girl in Sonoma County, California. The horse won three races and placed seven times in a racing career of 27 starts, earning $65,000. A couple of illegal alien ranch hands had a few drinks and thought they would have some kicks by running down animals in a field with a car and truck. The mare was struck and died of head injuries. Local animal lovers put together a $20,000 reward to find the culprits, a strategy which succeeded. Liobijildo Guzman Herrera and Noel Guido-Silva, both of Mexico, were arrested June 13. If convicted, the men could spend a year or more in prison and have to pay substantial fines. Court update: The two accused horse-killers originally pleaded no contest in September, figuring they would get a slap on the wrist. When they found out that the sentence would be three years in state prison, they decided to withdraw the no contest plea and request a jury trial, which is now set for Feb. 4, 2004.

SAN DIEGO – San Diego police shot and killed an armed 17-year-old driver during a traffic stop Saturday night in which he reportedly backed his SUV into a patrol car. Police said officers saw the vehicle run a stop sign at Pyramid and Kenwood streets in the southeastern community of Emerald Hills about 10:45 p.m. They turned around and found the driver had pulled into a home’s driveway about a block away on Bollenbacher Street.

As officers approached on both sides, one saw what appeared to be a gun on the passenger seat and yelled to his partner, who grabbed at the driver’s wrists. Police said the teen pulled his hands free, shifted the SUV into reverse and crashed into the squad car. The vehicle then was driven forward and both officers opened fire. Police said the SUV struck a garage door, backed up and drove forward again, turning toward an officer before finally crashing into a parked car.

The county Medical Examiner’s Office identified the youth as Noe Rojas of Mexico. He died at the scene about 11:15 p.m. Rojas apparently had been visiting a brother and cousin who live a few blocks from the shooting. At the house yesterday, the wife of one of Rojas’ cousins said the teen has been living in San Diego’s Normal Heights area for about a year, working construction. The in-law, Zamaida Lopez, 19, said Rojas briefly stopped by his relatives’ Pyramid Street home Saturday night. He may have been intoxicated, Lopez said, adding she didn’t know whether he owned a weapon. Lopez said her in-laws heard about the shooting from neighbors, but police at the scene would not let the teen’s brother, Israel Rojas, see or go near him. Yesterday afternoon, she said the grieving family still knew little about how or why Rojas was killed.

A food factory worker has been arrested on charges he sprinkled glass and other debris into Chinese vegetable dumplings.Albert Vidal Torres, of Ontario, pleaded not guilty Monday to federal charges of tampering with consumer products. The charges carry a maximum sentence of 40 years in federal prison.

Prosecutors say Torres, 33, contaminated the wontons in 2003 during the manufacturing process at Golden Crown Foods in Industry. The company has since moved to Ontario.
The dumplings were shipped to markets across the state. Golden Crown Foods discovered the contamination after customers complained about finding odd things in their wontons.
In addition to glass, prosecutors believe Torres also contaminated the dumplings with seeds, pebbles and spit.

Nobody was hurt, although the company was forced to recall and destroy nearly $23,000 worth of dumplings, according to the U.S. Attorney’s Office in Los Angeles.
Torres allegedly told his employer he did it to retaliate against the company after it fired his brother-in-law, prosecutors said. The company has since retooled its manufacturing processes to make its products less vulnerable to attack.

Torres is named in a five-count indictment that also charges him with using a fraudulent green card and possessing a fake Social Security number

WHIDBEY ISLAND 2 Dead, 2 Wounded, 7-yr-old Raped

• In June 2002, these four residents of Whidbey Island in Washington were the shooting victims of a Jamaican national who was evidently frustrated that he had ruined his plans to get a green card through marriage to an American woman. Preston Dean "Hugh" Douglas angered his girlfriend Holly Swartz because he had sexually abused her seven-year-old daughter. When Holly moved herself and her child into her mother's house, Douglas reacted by shooting Holly, her mother Marjorie Monnett (the mother of eight children), Marjorie's son Bruce and Bruce's girlfriend Sierra Klug. Holly and Marjorie were killed, and Bruce and Sierra survived. Douglas shot and killed himself. Reportedly Douglas was in the country illegally, although he was working as a bouncer at a local Chinese restaurant.
