Illegal Immigrant Faces Death Penalty For Phoenix Murder

Suspect has been deported five times since 1988

Maricopa County Attorney Andrew Thomas says his office will seek the death penalty against an illegal immigrant who allegedly shot and killed a Phoenix man in May. Demetro Acosta-Uribe, 42, is charged with murder in the death of Ivan Santos. Santos was shot to death after he was bound and his head covered in plastic wrap.

Thomas says Acosta-Uribe was deported five times. The first one took place April 29, 1988, and the most recent deportation occurred on May 7, 2004. "The murder case is a textbook example of how wide open borders expose the Valley to violent crime," says Thomas. "It is amazing -- but, sadly, all too common -- that a criminal suspect who had been deported from this country five times was back again committing more crimes."

Two other men were found on the property where Santos' body was found. They were both restrained in the same manner. Neither had been shot, but one of the men would have suffocated had a neighbor not rescued him. Thomas says the case underscores the importance of securing America's borders. "The government's continuing failure to control our borders has made Maricopa County's residents vulnerable to the worst kinds of violence."

Suspected illegal immigrant charged with raping Pa. woman

KLINGERSTOWN, Pa. - State police say a suspected illegal immigrant from Mexico assaulted and raped a woman inside her Schuylkill County apartment.

Police say 28-year-old Justino Diaz Espiridion entered the 20-year-old victim's apartment in Klingerstown without her permission late Sunday, hit her in the head and stomach and raped her.

He's facing charges of rape, burglary and related offenses. He's jailed under $35,000 bail.

State police Sgt. Craig Stine says Espiridion is a migrant farm worker who had been in the country only a few months. He says Espiridion was "infatuated" with his victim but that she had spurned his advances.

Stine says Espiridion didn't have any work papers and police suspect he is in the country illegally.

Upset at his wife because she cut her hair without his permission, Carlos Manuel Fuentes got drunk and hit her 6-week-old child over the head with a beer bottle, Homestead police said.

Fuentes, 27, of 225 NE 13th St., was charged over the weekend with aggravated child abuse.

He is being held at Miami-Dade County Jail with no bond.

According to a police report, the child's mother called police.

The child suffered a cut to the top of the head and was taken to the hospital.

Homestead police found broken glass from the beer bottle inside the child's room. Fuentes was ''severely drunk'' and his breath and body reeked of a ``strong odor of alcohol.''

Fuentes said he ''didn't mean to do it, but he was just upset at his wife for cutting her hair without his permission,'' the arrest report says.

It was not clear from the report whether Fuentes is the child's father.

Man held in fatal Hanover Park attack on homeless man

A Cook County judge set bail at $1 million Monday for a homeless illegal immigrant charged in the beating and murder of another homeless man last week in Hanover Park.

Antonio Pacheco, 28, appeared before Judge Kay Hanlon in the Circuit Court branch in Rolling Meadows. He is charged with two counts of first-degree murder in the death of Alexis Roman, 31.

According to Assistant State's Atty. Scott Biestek, Pacheco and Roman were drinking behind a building in the 2100 block of West Lake Street about 1 a.m. Sept. 5 when Roman made sexual advances toward Pacheco. Pacheco picked up a rock and struck Roman in the head, continuing to beat him after he fell, Biestek said. Pacheco made a videotaped statement implicating himself in the crime, said Biestek.

GILBERT, SC (WIS) - It's been three months since a 33-year-old father was shot and killed at a Gilbert chicken farm. Deputies say the few leads they had on the killer haven't gotten them anywhere, and they need help.

The details are baffling, the circumstances unbearable for the family of Russell Reeder. "If he was killed in an accident or something, that we can explain. But no - he was murdered," says Reeder's cousin, Joni Son.

Reeder's family is talking for the first time about the night he was killed.

'"He was shot nine different times. Why would somebody shoot him that many times?" asks Son. "These thoughts just run over and over and over and over again in my mind."

Reeder left behind a five-year-old daughter.

Officials believe it was a fight about an ex-girlfriend that led to the shooting. The fight was with an illegal Mexican immigrant named Gregorio Rodriguez. Authorities say Rodriguez killed Reeder after a long night of drinking.

Son says, "The details really do haunt me."

The details include where Reeder's body was found - at a Gilbert chicken farm. Authorities say the man who killed him lived and worked there.

Six weeks after the murder, that suspect remained elusive, one step ahead of authorities. "We had a couple of leads on where he may have been at and we hit those places and just missed him," says Lexington County Sheriff James Metts. Sheriff Metts was hopeful when authorities found a truck in early July - a Nissan pickup officials say Rodriguez drove from the farm.

But leads have been few and far between since the truck was found, and Rodriguez has remained out of sight.

[b]"He could be in Mexico; he could be here. We simply don't know.]/b] That's why we need help from the public," says Sheriff Metts.

"We're asking anybody and everybody if you know this guy, if you see this guy, please contact the police," says Son. "Until we catch this guy, there will be no closure."

Alfonso Mejia, 23, of Vine Street, was arrested Sunday for driving while intoxicated after two county sheriff's officers observed an accident involving two vehicles, including the one Mejia was driving, at West Avenue and Bowentown Road. The sheriff's officers detained Mejia, who reportedly attempted to flee the accident scene, until city police arrived.

Mejia was also cited for refusing to submit to blood-alcohol content testing. He was also charged with hindering apprehension and/or prosecution, was served three failure to appear warrants, and was lodged in the county jail in lieu of $2,133 bail.

Police notified Immigration and Customs Enforcement that Mejia is in the country illegally.

A twice-deported Salvadoran immigrant was charged with strangling an acquaintance during a fight Sunday, Prince William County police said Wednesday.

Christian Molina, also known as Jose Maximino Flores-Perales, 30, of 9011 Whispering Pine Court, Manassas, was charged with the murder of 51-year-old Ronald Dean Hollingsworth.

The two men were at a mutual friend's house at 10625 Dumfries Road - a rundown house near a gas station by Old Dominion Speedway. The two had been drinking when they began to fight, Hernandez said. Molina then strangled Hollingsworth, police said.

A third man, whose name was not released, was also at the house and called 911 when he realized Hollingsworth was not moving, police said. Around 5:20 p.m., police responded to the call of an unconscious man and Hollingsworth was taken to a local hospital where he was pronounced dead.

Hollingsworth apparently lived in an abandoned, boarded-up shack near the house where his body was found, police said.

No one answered the door at the house on Dumfries Road on Wednesday evening.

Police arrested Molina after the Medical Examiner's autopsy revealed that Hollingsworth's injures were consistent with strangulation, Hernandez said.

After fingerprinting Molina, police learned that he was deported in 2003 and 2005 because of his illegal status and for criminal activity, Hernandez said.

Molina is being held without bond pending an Oct. 16 court date. Police have obtained an Immigration and Customs Enforcement detainer for Molina.

An illegal immigrant who was about to be deported has been charged with raping three Charlotte women in a series of attacks that left police frustrated and female joggers leery for nearly two years.

Jose C. Rivera, 26, was in Atlanta awaiting deportation when the rape charges were filed Friday. The charges will stop the deportation proceedings.

Rivera is accused of attacking three women in different parts of Charlotte between April 2004 and Sept. 2005. Police say he talked his way into a victim’s home, attacked another in the common area outside her apartment, and then, wearing only red underwear, grabbed a jogger who was running alone.

A month after that rape, in October 2005, Charlotte-Mecklenburg police announced that they had evidence connecting the three rapes, but had been unable to identify the attacker. They used DNA to link the cases.

It’s unclear what evidence detectives now have to connect Rivera to the attacks. But last year, he was convicted of receiving a stolen vehicle. As a felon, he would have been required to surrender a DNA sample.

Charlotte-Mecklenburg police would not comment on details of the case Monday. Spokeswoman Julie Hill said detectives had not interviewed Rivera and fear the publicity could jeopardize their investigation. The warrants, however, are public record.

As Mecklenburg’s immigrant community has grown in recent years, illegal immigration has become a controversial topic. Since last spring, the Mecklenburg sheriff has been working to identify illegal immigrants among jail inmates and get them deported.

Records show Rivera, who’s from Honduras, has been jailed in Mecklenburg County at least eight times since 2004. In November 2006, he was deported, a spokesman with Immigration and Customs Enforcement said.

Most recently, Rivera spent five weeks in the Mecklenburg jail on breaking and entering charges.

Because he was not charged with a violent felony and was about to be released, the sheriff turned him over to immigration officials Thursday, sheriff’s spokeswoman Julia Rush said.

Rapes by strangers are uncommon in Charlotte-Mecklenburg and across the country — and more difficult to solve than acquaintance rapes. Nationally, about seven of 10 women who report sexual assaults know their attacker. Each of the women Rivera is accused of raping was attacked in the morning by a man with a weapon.

The first was April 2, 2004. A 32-year-old woman told police a stranger talked his way into her apartment on Roseview Lane off Eastway Drive around 10:45 a.m. Once inside he pulled out a handgun and raped her. Police would not say what the man said to get in the door.

On Feb. 19, 2005, a 41-year-old woman told police a man overpowered her outside apartments on Woodway Hills Drive off Independence Boulevard around 4:30 a.m. He forced her to perform oral sex on him and raped her. The man used a sharp instrument as a weapon.

Then, on Sept. 25, 2005, a female jogger told police a man grabbed her and threatened her with a screwdriver as she ran along East Boulevard in Dilworth around 7 a.m. The woman said the man pulled her behind a building near Springdale Avenue and raped her. He was wearing only red underwear, and a white cloth covered much of his face.

Last January, police said the serial rapist may have attempted to strike again, after a 41-year-old woman in Myers Park fought off a man with Tae Bo, a type of kick-boxing exercise.

The woman told police she was walking alone when he came up behind her and reached his hands between her legs to try to pick her up.

She screamed and kicked the man, who fled without physically injuring her.

That woman’s description of her attacker closely matched the description given by the woman attacked in Myers Park, police said. Rivera has not been charged in that case.

In 2005, police interviewed three victims and released this description: The suspect is a 5-foot, 7-inch Latino man, between 25 and 30 years old, with a slim build. He has short black hair and a very short, neatly trimmed beard and mustache. One victim first described him as Middle Eastern.

THE CHARGES

Rivera faces 16 charges in the three attacks. Fourteen are felonies. The charges are:

• Five counts of kidnapping.

• Four counts of rape.

• Three counts of sexual battery.

• Two counts of sex offense.

• One count each of robbery with a dangerous weapon and breaking and entering.

Illegal immigrant charged in wreck

ROCKINGHAM, N.C. -- An undocumented immigrant faces murder charges in connection with a deadly hit-and-run accident in Richmond County.

Rockingham police say 21-year-old Eduardo Alejandro didn't stop at a light on Highway 74 and hit another car.

Reginald McEachin, 25, was taken to Rockingham Memorial Hospital where he died.

Officers say Alejandro jumped from his vehicle and ran from the scene. Police chased him and called in K-9 units and caught him. Alejandro is charged with second-degree murder, hit-and-run, driving while impaired and reckless driving. He is in jail without bond.

Police are still looking for the passenger who was in Alejandro's car at the time of the crash.

Illegal immigrant indicted on child pornography charge

A Chesapeake grand jury has indicted a 19-year-old who police say is an illegal immigrant on a charge of producing child pornography.

Carlos Ramos, of the 3700 block of S. Military Hwy. in Chesapeake, was arrested in May after a Wal-Mart store clerk processed film he had dropped off and that included images of a nude 13-year-old girl, police said. The grand jury, which convened this week, also indicted Ramos on a charge of carnal knowledge.

A clerk at the Wal-Mart on Grassfield Parkway alerted police after processing the pictures. When Ramos arrived at the store to pick up the pictures, police questioned him. Ramos said he had been dating the girl, police said.

The child's mother said she was unaware of any sexual activity between the child and Ramos, police said. The girl admitted to a relationship.

His carnal-knowledge charge stems from a Feb. 15 offense, according to court records.

Police said they discovered during an investigation that Ramos is in the country illegally and contacted Immigration and Customs Enforcement officials.

His trial is scheduled this month. If convicted, he faces up to 10 years in prison on each felony charge; police said he would serve his sentence, then be deported.

TIGARD, Ore. - Imagine giving someone your trust, and access to your children, then having them turn around and break that trust in the worst way.

That is what police say a Tigard man did, and now he is on the run from the law.

His name is Ramon Perez Reyes, a young man police say lived in a Tigard apartment complex off Southwest 76th and Bonita.

It was there, Detective David Hockin with the Tigard Police Department says, that Perez Reyes molested a 12-year-old girl and a 7-year-old boy.

"The 7-year-old, of course, is just very young and I think he realizes, but I don't think he fully understands or grasps, what has happened and how serious it is," Hockin said.

Hockin said it is unusual for victims to be of different genders.

He believes the suspect may have fled back to Mexico at one point and returned, even to the Tigard-Tualatin area.

An arrest warrant has been issued for Perez Reyes on 15 counts of molestation.

"My biggest concern is that he's obviously living somewhere and there's a good chance he has access to other kids that same age, whether it be at an apartment or a house," Hockin said. "So he could be out there perpetrating right now for all we know."

Police say given this man's ties in the area, there is a chance he is still around and they hope anyone who sees him or who has information about his whereabouts will call 911 or the Tigard Police Department.

6 years in prison for molesting 2 boys

COOK COUNTY - An undocumented immigrant who pleaded guilty Monday to molesting the two teenage sons of a church couple who befriended him drew a sharp rebuke from the judge who sentenced him to 6 years in prison.

Alejandro Bautista, 33, of the 1400 block of Devonshire Lane, Hoffman Estates, pleaded guilty to criminal sexual assault and aggravated criminal sexual abuse before Cook County Circuit Judge Thomas Fecarotta Jr.

An angry Fecarotta asked Bautista if he was a legal immigrant. Through an interpreter, Bautista said he crossed the U.S.-Mexico border illegally.

"You cross our border to molest our children?" Fecarotta asked in the Rolling Meadows courthouse. "When you get out of prison, go back to your country. Stay out of ours."

Bautista was a maintenance worker at Bethel Baptist Church, 600 Lake St., Bartlett, and had been living for several years in Hoffman Estates, authorities said. He was befriended by a church family and became close to the two boys, ages 15 and 13, who went to Bautista's residence to watch movies, authorities said.

The 13-year-old told authorities Bautista touched him inappropriately in January while they were watching a movie and the 15-year-old said Bautista touched him last fall.

Bautista's female roommates notified police, authorities said. Bautista has been in custody since his arrest in January. He faces deportation upon his release from prison. Bautista also will have to register as a sex offender.

Illegal immigrant arrested for alleged sexual contact with boy, 8

A 41-year-old illegal immigrant was arrested Saturday for allegedly having sexual contact with an 8-year-old boy at a home on the city’s south side, Sheboygan police said.

The incident was reported by the boy’s mother about 3:45 a.m., soon after the assault is believed to have taken place, said Detective Matt Walsh.

The man, who police will ask prosecutors to charge with first-degree sexual assault, is the third illegal immigrant arrested for a felony offense in recent weeks.

Few details on the nature of the assault were available Saturday, but Walsh said police believe it is a one-time occurrence. He said the boy’s mother suspected something had happened and called police after confirming it with her son.

The man was a friend of the boy’s family and is believed to have been living in Sheboygan about six months, Walsh said.

In other recent cases, illegal immigrant Eddie Carbajal-Lile, 27, has been charged with causing a fatal crash that killed a Port Washington teen on Aug. 14, and 17-year-old Martin L. Gamez - whose immigration status is being questioned by federal authorities - was charged Friday with sexually assaulting an 8-year-old girl on Aug. 16.

Another illegal immigrant, Mauro Cisneros, 33, was arrested Aug. 20 for a traffic violation and police discovered he was a twice-deported felon with previous arrests for drug dealing, kidnapping, burglary and robbery.

Illegal immigrant arrested for fondling two girls in Bedford County

In Bedford County, sheriff's deputies have arrested an illegal immigrant for fondling two young girls.

Police say the incidents happened inside a Goodwill store in Forest on Saturday.

Employees grew suspicious of the man and called 911. Police arrested Santos Guzman. He's currently being held at the Blue Ridge Regional jail facing several charges including fondling two eight-year-olds.

Guzman is from El Salvidor and entered the U.S. illegally in 2004.

The Sheriff's Department has contacted Immigration & Customs Enforcement to find out more information on this man.

Bossier deputies arrest illegal immigrant

An illegal immigrant was arrested in Bossier City over the weekend after being pulled over during a traffic stop.

Victor Hugo Valdivias, 18, of Monroe, faces a variety of charges including carnal knowledge of a juvenile, said Bossier sheriff spokesman Ed Baswell.

Deputies stopped Valdivias Sunday morning, near the intersection of state Highway 527 and Willis Road. He didn’t speak English, didn’t have a driver’s license and had a 14-year-old female in the vehicle.

The female told deputies she had sneaked out of her house in Monroe to meet Valdivias, who took her to a motel in Bossier City and had sexual intercourse with her, Baswell said.

Valdivias had no identification and is believed to be a citizen of Mexico, having entered the United States illegally.

He was booked into the Bossier Maximum Security Facility on charges of carnal knowledge of a juvenile, contributing to the delinquency of a minor, operating a vehicle without lawful presence in the United States, switched tags and resisting an officer, Baswell said.

His bond is set at $53,600.

Bountiful American Legion publicizes link with illegal aliens

BOUNTIFUL -- The American Legion commander here is taking an active role in the fight to protect Utah children from illegal immigrant-driven identity theft.

In response to an investigation by federal and state officials, American Legion Post 79, in Bountiful, adopted resolutions recently on identity theft driven by illegal aliens. The resolutions have since been approved by both the Utah and National American Legion conventions.

According to the Utah attorney general's office, the investigation "uncovered an alarming new crime spree involving illegal aliens and identities stolen from victims under the age of 12."

Ronald Mortensen, commander of American Legion Post 79 and co-founder of CitizensForTaxFairness.org, said that using government funds to hire individuals using stolen identities is a misuse of taxpayer money.

Mortensen said he has spoken to a number of groups and government organizations on how they can help reduce identity theft.

"Our resolutions on illegal immigration address an area that is often overlooked," he said. "Illegal alien-driven identity theft is a serious felony that impacts thousands of Utah children each year."

In June, the Utah American Legion convention adopted Post 79's resolution that opposed the use of taxpayer funds to hire illegal aliens using unlawfully obtained Social Security numbers and other fraudulent documents. The resolution also called on Utah governments and businesses to verify the Social Security numbers of all new hires.

In August, the American Legion's national convention adopted Post 79's resolution that calls on Congress to immediately deport illegal aliens convicted of identity theft.

The resolution also calls on Congress to help the victims of illegal alien identity theft reclaim their identities and remove derogatory information from their records.

Mortensen said some illegal immigrants commit identity theft because they have to get a Social Security card before they can be hired by law-abiding employers.

"It is time that our employers, our state and local governments and civic leaders acknowledge there is a problem and that we need to do something about it," Mortensen said.

Mortensen said he acknowledges that identity thieves exist in all segments of society. Parents with poor credit have been convicted of stealing their own children's Social Security numbers to get loans or find jobs, he said.

Many people who steal identities target children, because the thefts are unlikely to be discovered until the children apply for credit cards or loans as teenagers.

According to a 2005 news release from the Utah attorney general's office, Mortensen said, the identities of 1,800 Utah children under the age of 12 have been stolen.

In other cases, someone will fraudulently make up a Social Security number, and then the government will unknowingly assign the number to a child.

"Sometimes the child will have a credit history before it is even born," said Mortensen. "It's something that definitely has to stop."

EAST COUNTY: A woman in a car carrying 186 pounds of marijuana stabbed a Border Patrol agent in the leg while trying to get away yesterday, a U.S. Customs and Border Protection official said.

The agent disarmed the woman and detained her until other agents arrived. He was taken to a hospital and later was reported in good condition, a border official said.

The incident began about 11:50 a.m., when agents got a tip that people were loading something into the trunk of a Chevrolet Impala near Tierra del Sol, off state Route 94 in Campo.

Agents tried to pull over the driver, then used a spike strip to flatten the tires and halt the car on Route 94 west of Buckman Springs Road. The driver jumped out and ran, but the female passenger allegedly used a pocketknife with a 3-inch blade to stab an agent in the left thigh. Agents found marijuana in the trunk, caught the driver and arrested him and the woman. –P.R.

Suspect in Sunnyside shooting apprehended at U.S. border

A man wanted in a double shooting in Sunnyside earlier this summer was caught by U.S. Border Patrol agents in California recently.

Alberto R. Irigoyen-Murillo, 27, of Auburn, Wash., is a suspect in the shooting of Martin Munoz and Efrain Hernandez in the parking lot of the Acapulco Restaurant in June. Sunnyside police said Irigoyen-Murillo and the victims were involved in an argument in the restaurant prior to the shooting. Munoz was shot in the face and Hernandez was shot in the shoulder.

Police located Irigoyen-Murillo's vehicle shortly after the shooting but it was not until Aug. 30 that he was caught while allegedly trying to re-enter the country illegally in San Diego County. Border Patrol agents said he had been trying to climb back over the fence, and after he was detained a fingerprint check turned up the warrant for his arrest in the shooting.

Extradition proceedings to bring Irigoyen-Murillo to Washington state are under way, according to Sunnyside police.

UNION CITY - A family game of dominoes turned bloody - and almost deadly - when an intoxicated man tried to stab an opponent Monday, police reports said.

Patricio Cornejo, 47, of 24th Street, was charged with attempted murder, endangering an injured victim, exhibiting a fraudulent license, possession of weapons for unlawful purposes, and unlawful possession of a weapon, reports said.

Responding to a stabbing report at 4:50 p.m., police found a 41-year-old Union City man lying on the floor of a New York Avenue apartment and bleeding profusely, police said.

During the game, Cornejo, who had been drinking, became belligerent and got a knife from the kitchen, and returned to the game and began stabbing the victim, reports said.

Cornejo is an illegal immigrant and convicted felon who had been deported, police said.

Cornejo is being held on $100,000 bail, police said. The victim is in critical but stable condition at the Jersey City Medical Center, reports said.

A man accused of fatally shooting a Burlington City man and wounding his former girlfriend over the weekend is an illegal alien and a street gang member, a prosecutor told a judge Tuesday.

The suspect, Jesus Avila, 22, of Kinsley Road in Pemberton Township, remained in the Burlington County Jail Tuesday after a Superior Court judge reaffirmed his $1 million bail.

Deputy first assistant county prosecutor James Ronca said Avila was not only an undocumented alien from Mexico but was out on bail on a minor charge when the shootings occurred Saturday.

Avila is charged with killing Gilbert Parra, 19, of Burlington City and wounding a 17-year-old girl, identified as Avila's former girlfriend, in the ankle.

Ronca said the shootings followed an argument over the girl that began on the telephone and continued after Avila drove to the house on the 400 block of Washington Street with three friends. The prosecutor said Parra was found lying outside the house while the girl was inside the home when she was shot.

"Jail personnel said they saw tattoos identifying him (Avila) as a member of a street gang, but I want to emphasize this murder was not gang-related," Ronca told Superior Court Judge Patricia LeBon.

Ronca did not identify the gang.

He also said a number of eyewitnesses who knew the defendant can place him at the scene of the crime, adding to other evidence in what the prosecutor considers a strong case against him.

Speaking through a court interpreter, Avila asked for a court-appointed lawyer to represent him but made no other comment and kept his head down during his court appearance via closed circuit television from the jail. He is charged with murder, aggravated assault and illegal possession of a firearm.

Parra's family members began to cry during the proceeding and were cautioned by a sheriff's officer not to disrupt the court proceedings. They made no comment afterward.

Ronca said Avila was charged previously with a creating a false public alarm and was free on $5,000 bail that had been set July 11 by Superior Court Judge James Morley. However, Ronca had no details of the earlier arrest.

LeBon granted Ronca's request to keep bail high after he said Avila was a flight risk mainly because of his illegal status in the U.S. and the earlier arrest.

RALEIGH - A 28-year-old man was being held Saturday in Wake County jail on four counts of second-degree kidnapping and four counts of armed robbery, according to police reports.

Arturo Gomez Navarro, whose address is not known, possessed a revolver while taking $1,620 worth of cash and jewelry from four people in a garage or parking lot at 2838 Wake Forest Road, police reports said.

Navarro is considered a flight risk and is a previously deported felon, according to the arrest warrant. Bail was set at $1 million.

Judge considers immigrant a danger to the community, denies him bond

A 21-year-old illegal immigrant charged with breaking into two women’s apartments early Christmas morning and trying to sexually assault them was denied release on bond Wednesday after a judge branded him a danger to the community.

“Mr. Dubon, it’s safe to say, is lacking in community ties,” Collier Circuit Judge Fred Hardt said of Christian Rene Dubon, 7710 Tara Circle in East Naples, who admitted he’d been here a year illegally. “He appears to be a danger for repeatedly attempting to enter houses and commit batteries.”

Collier County Sheriff’s Office reports say Dubon broke into two apartments early Christmas morning, even returning to the second apartment after a woman told him to leave. Reports say the first victim told deputies he’d tried to enter her home seven weeks earlier.

Dubon is charged with two counts of burglary with intent to commit sexual battery and offering to commit prostitution or a lewd act. He faces a maximum of life in prison on the top charges, first-degree felonies; the other charge is a second-degree misdemeanor.

The victims’ names are being withheld due to the nature of the crimes and their addresses and the general area where the crimes occurred was deleted from reports, which give the following account:

Deputies were called to an apartment at 3:38 a.m. Dec. 25 by a woman who said she was awakened by a man who grabbed her breasts. She said she’d fallen asleep on her sofa and forgot to lock the front door. She screamed for her husband, who was in the bedroom sleeping — prompting the intruder to “calmly” walk out the front door. When her husband checked what was wrong, he was gone.

She said that seven weeks earlier, he came to her sliding glass door and asked to see her. She said she didn’t know him, thought he was drunk and had the wrong apartment, so she told him to leave. Then her husband yelled at him and he left.

Deputies couldn’t find the man and the woman asked for extra patrols at her apartment.

Minutes later, at 4:46 a.m., they received a call about a burglary in progress from a woman who was screaming as she called the 911 operator. When deputies arrived, they found the front door locked and checked the rear, where the sliding glass door was open.

As a deputy approached, a Hispanic male came out from behind the closed blinds and attempted to leave the unenclosed lanai. He appeared surprised to see the deputy, who told him to stop in English and Spanish, but he refused. So the deputy aimed his Taser at the man’s right side, causing him to drop to the ground and comply with his orders. He was then arrested.

The woman told the deputy she’d been asleep in bed when the man entered her apartment through an unsecured rear sliding glass door. He grabbed her feet and tried to attack her, so she politely told him to leave. Instead, he edged toward her. She told him not to touch her, saying her husband would be home soon. The suspect acted as if he didn’t understand, prompting her to push him and threaten to call police.

He left, but soon returned through the open sliding glass door. He exposed himself and said, “Just pequeño?” — meaning he wanted just a little sex — and showed her some cash in his wallet. She said he was “very persistent,” so she went to the bathroom to call 911 and he followed, then left, only to be arrested as he was walking out.

The first woman positively identified him as the man who’d broken into her apartment and who tried to seven weeks earlier.

In court Wednesday, Dubon’s public defender, Shawn Nagle, had asked that his $505,000 bond be reduced to $30,000, saying Dubon had been unable to get out of jail since his arrest because he couldn’t afford to post bond, but he could pay $3,000 (the required 10 percent for $30,000).

If released, Nagle said, a relative, a pastor at a local Christian church, offered to allow him to stay at his home, and his former employer, Cummins & Raj, was willing to hire him back as a mechanic. Nagle said Dubon also would be willing to wear a GPS (Global Positioning System) electronic ankle monitor to track his whereabouts, which costs $13 daily.

But Assistant State Attorney Steve Maresca successfully argued against any reduction, saying Dubon had only worked here eight months before his arrest and was here illegally from Honduras.

VICTORVILLE — A 3-year-old girl was found abused and bleeding Thursday night, and officials have arrested her uncle, an illegal alien, for child molestation.

Salvador Luna, 29, who was previously deported, was arrested on suspicion of sexual abuse of a child and was taken to the Victorville sheriff’s station where he underwent a physical examination, said Detective Ryan Collins.

The victim was originally admitted to Victor Valley Community Hospital around 7 p.m. after her mother found the girl bleeding inside their home on Rockrose Street, said Detective Sgt. Bob Hughes.

“Her injuries were significant enough that she had to be admitted,” Hughes said.

Around 6:30 p.m. the mother, father, the 3-year-old and her siblings were watching television in the parent’s room, a few doors down from where Luna was staying, Hughes said.

The girl went to Luna’s room for a piece of candy, and when she returned, a sibling took the candy from her, authorities explained. The girl again went into Luna’s room, hoping to replace the stolen sweets.

“She is in the uncle’s room for a while this time, long enough for mom to wonder where she was,” Hughes said. “When mom found the child she could see that she was visibly upset. Mom picks her up and when she put her down, now there’s blood all over mom’s shirt.”

The woman took the child to a neighboring home where the resident was a nurse to have the girl checked out. The nurse immediately dialed 911 and advised the family to stay away from the home until authorities arrived, said Karen Hunt, spokeswoman for the Victorville station.

Officials arrived at the home and had Luna in custody in under five minutes, Hughes said.
Luna had apparently changed clothes by the time officials arrived, so the home was closed off and searched for physical evidence, Hughes said.

In 2000, Luna was arrested in Ventura County on suspicion of annoying or molesting a child and sexual assault, said Detective John Wickum. It is unknown whether Luna was convicted, but the family said he was deported shortly after, officials confirmed.

“His criminal history drops off in 2001,and he re-surfaces again in 2006 with a DUI arrest in Victorville,” Wickum said.

Additional information came in that there could be as many as four other family members who have been past victims, but that remained under investigation on Friday, officials said.
Results of medical examinations on both the victim and Luna are still outstanding, but authorities believe they might shed additional light on the case.

“This is like the smoking gun of molestation cases. There are so many reports and investigations where it can take months to get to the bottom of things. It’s rare to catch something in progress and be able to respond and arrest the suspect immediately,” Wickum said.

Anyone who may have information about Luna is asked to contact the Detective Bureau at the Victorville station at 241-2911.

Luna is being held at the Victor Valley Jail on $250,000 bail, officials said.

“Not reverse discrimination, but discrimination,” McKenna said. “I’m being discriminated against whether I’m Hispanic or whether I’m English. The fact that somebody’s singling me out because I don’t speak a specific language or I don’t fit their criteria of what I should be in this particular plaza I don’t think is fair.
“If it were reversed and I was Hispanic and there were two other American businesses in here occupying the other storefronts and the owner of the property said to the Hispanic business owner, ‘Guess what? You’ve got 30 days to move your business outta here because … I want an English-speaking plaza serving the English people in the area,’ there’d be a firestorm from all civil-rights groups across the country including the ACLU.”
WND spoke with McKenna during a small “end of an era” ceremony yesterday outside the vacated office where the Stuart, Fla., resident based his water-conditioning business for the last seven years.
An American flag flying from the top of Seacoast’s former headquarters was taken down, and a small group of friends and former colleagues were treated to free hot dogs and beer.
McKenna had Old Glory flying as a sign of American pride, while he vented his frustration. He believes many illegal aliens are being given preferential treatment over U.S. citizens.
“There are a lot of people [who over the years] came from other parts of the world who didn’t speak English. They came in the early 1900s and they learned that the only way they were going to further their career and to further their families’ wealth was to learn English – and they did. It seems like now it’s reverse, like, ‘OK, they’re Spanish and we gotta learn Spanish because we gotta get along with them.’”

A man in the country illegally is arrested for attempted sexual assault

Javier Ramos has admitted his involvment in the incident and that he is an illegal alien.

On Thursday August 30 (2007) at about 5:20 pm a 13 year old girl was shopping at Fry's at 74th Avenue and Cactus with her father. As she was coming out of the ladies' room in the store Javier Ramos has admitted to police he forced his way in to the ladies' room, grabbed the girl and forced her to the floor. Several people heard her screams and when they opened the door the suspect ran out being followed by several of the witnesses. One of the witnesses caught up to Ramos as he tried to enter his car, a scuffle ensued, and Ramos escaped after assaulting the man by kicking him in the stomach. Ramos continued on foot and remained within the perimeter we had set up. He attempted to evade officers by approaching homes in the area asking for work, but a citizen who recognized him from the incident grabbed Ramos and held him until police officers arrived.

Ramos was booked for kidnapping, attempted sexual misconduct with a minor, aggravated assault on a minor, and for an outstanding warrant on the driving on suspended.

Ramos also admitted to police he is in the country illegally.

Contrary to what President Bush claims, family values do stop at the Rio Grande for many illegal aliens. In fact since 1999, there have been more than 1,000,000 sex crimes committed in the United States by illegal aliens.

In addition to suppressing wages, driving drunk, bankrupting our hospitals, and over-crowding our jails and public schools, illegal aliens are preying upon our children. Using U.S. Department of Justice, Immigration, as well as state and local law enforcement data, the Violent Crimes Institute has determined that there are no less than 240,000 illegal alien sex offenders currently inside the U.S.

In Operation Predator sweeps conducted since July 2003 across this country, Immigration and Customs Enforcement agents nabbed over 8,500 foreign national child molesters and rapists. Many of these predators had been previously convicted of other crimes, and many had already been deported once.

The Americans For Legal Immigration Political Action Committee (ALIPAC) recently tracked child sexual assaults committed by illegal aliens. In a 30 day period, they recorded 27 assaults by foreign nationals illegaly inside the United States. The results are as follows:

Truck in fatal crash appears to have had no violations

CARLSBAD ---- A big rig from Mexico that stalled on Interstate 5 this week and was rear-ended by a van in a fatal crash that killed the van's three occupants, does not appear to have a history of safety violations, California Highway Patrol authorities said Wednesday.

A Carlsbad couple, Robert and Marie Jennings, both 67, and their 19-year-old grandson, MiraCosta College student David Michael Jennings II, died in the pre-dawn crash Tuesday in the freeway's southbound lanes.

The truck lost its drive train and stalled in the No. 4 lane about 10 minutes before the 5:15 a.m. accident south of Carmel Valley Road, Officer Mark Gregg, Highway Patrol spokesman, said Wednesday.

"We had a couple of people say, 'Yes, I saw it. I managed to avoid it,' " Gregg said.

He said the truck's hazard lights were flashing and the driver didn't try to leave the cab in the dark to take additional safety precautions in the full-speed traffic.

Meanwhile, friends and family of the victims were making final arrangements and sharing memories Wednesday at the home of Robert and Marie Jennings, who had opened their Shale Court house to their grandson while he attended MiraCosta.

David Jennings II was in his second year at the college, planning to transfer to UC San Diego this fall to continue his pre-med studies, said his father, David Jennings, of Beavercreek, Ohio.

"We will miss the goodness in him ... that he used to touch everything around him," Jennings said in a phone interview from the Jennings' Carlsbad home Wednesday afternoon.

The father said he doesn't hold the truck driver "responsible for any of this."

"It was an accident," Jennings said. "I hold no animosity towards the trucking company, if everything was in order, as the investigator said."

Wayne Hartwig, motor carrier unit manager for the Highway Patrol's Border Division in San Diego, said the truck is owned by Transportes De Baja California in Tijuana.

The company has at least eight big rig tractors and 35 trailers, Hartwig said.

Six violations were noted on the company's carrier citation history within the past 10 months at the Border Patrol's Otay Mesa inspection area, said the unit manager.

Hartwig said preliminary investigation indicated four of those citations did not involve the stalled truck. He said he hadn't been able to trace the other two violations to specific Transportes De Baja trucks.

At the Jennings' home, plans were made to hold a memorial service some time Friday evening for David Jennings II at St. Patrick's Catholic Church in Carlsbad.

In his biography on the MiraCosta Web site, David Jennings II talked about his plans and how he liked to spend time on the computer, hang out with his friends, bodyboard and surf.

The MiraCosta student ambassador encouraged high school students to stay in school and attend college, worked with special-needs students, and was a part-time employee at an Encinitas store, said Jan Moberly, MiraCosta coordinator of school relations and outreach.

"He was a joy," Moberly said. "He just couldn't do enough."

Counselors were helping students cope Wednesday with the death of their friend, who spearheaded the "Run for the Fund" 5K scholarship fund-raiser last October.

David Jennings, who ran the 5K with his only son, said he and his wife, Kristi, who have four daughters, will establish a MiraCosta memorial scholarship for transfer students.

An 11 a.m. service will be held Saturday for Robert and Marie Jennings at St. Patrick's Catholic Church in Carlsbad, said their daughter, Sheryl McGurk of Alexandria, Va.

She said her parents, married 45 years, were on their way to the Bahamas to see their third child, Bob Jennings, perform in a play when they died.

"My father was in the first graduating class of the Air Force Academy in 1959," McGurk said. "His wife adored, loved and supported him for his career of 27 1/2 years. He retired as a colonel."

Her parents continued to be busy over the years, vacationing in Carlsbad before moving there in 2002, she said.

On Monday morning, Marie Jennings attended a rally in Carlsbad to try to prevent the city from drastically lowering Lake Calavera for a dam repair project, citing the lake as one of the "scenic things we still have left."

"We got to spend a lot of wonderful times together this past year," McGurk said about the entire family. "The only comfort we're finding is we know our parents and David went to heaven together."

Brewster man accused of molesting 2 girls

BREWSTER - A 32-year-old village man who police say is in the country illegally is facing charges that he sexually abused two girls, ages 10 and 11.

Sergio Antonio Martinez-Garza is being held in the Putnam County jail on $100,000 bail, according to the Putnam County Sheriff's Office.

But even if he posts bond, he won't be released, because federal immigration officials have put a detainer warrant on him, ordering the jail to hold him pending possible deportation proceedings, police said.

Martinez-Garza, of 550 N. Main St., fondled the girls at a residence in Brewster, police said.

The suspect and the girls know one another, and the crimes were not random acts, police said.

Sheriff's investigators arrested him Sunday, charging him with two felony counts of second-degree engaging in a course of sexual conduct against a child.

The sheriff announced the arrest yesterday.

Martinez-Garza was arraigned shortly after his arrest and is due back in court on Sept. 10.

That is the same date that two other village men in the country illegally are due in Village Court to answer charges of statutory rape.

Police said Pedro Sagastume, 21, and Jeremias Perez, 22, had sex with two girls, 13 and 15, in the men's apartment at 167 Main St. last month.

The two men have been held on $50,000 bail since their July 15 arrests.

Sagastume, accused of having sex with a 13-year-old Southeast girl, is charged with second-degree rape, a felony punishable by up to seven years in prison. Perez, accused of having sex with a 15-year-old Brewster girl, is charged with third-degree rape, a felony with a maximum sentence of four years.

Police said the girls allegedly victimized by Martinez-Garza were not physically injured and were referred to Child Protective Services. Each of the charges against him could result in seven years behind bars.

After the arrest, sheriff's investigators identified Martinez-Garza as a Guatemalan in the country illegally and notified federal immigration officials and the Guatemalan Consulate that he was being held in the Putnam jail, police said.

Manchester man charged with sex assault, threats

A city man is charged with having a sexual relationship with a 14-year-old girl, and threatening to kill her older brother who questioned his immigration status.

Alan Hernandez, 18, of 287B Lake Ave., Apt. 1, was arraigned yesterday in Manchester District Court - with the assistance of a Spanish interpreter - on felony charges of criminal threatening and felonious sexual assault. He pleaded innocent to a misdemeanor count of simple assault.

The teen's mother went to police Sunday at 4 p.m. to report the assaults. She said her daughter, who is pregnant, and Hernandez had broken up and she was staying with a relative in Allenstown.

The mother told police on Sunday Hernandez showed up at her Green Street residence looking for her daughter. He had an argument with her son about his immigration status.

According to court records, the 26-year-old son asked Hernandez for $10. When he said he didn't have the money, the son took out a paper about illegal immigrants and "Alan went off the deep end," Officer Justin Maguire wrote in his sworn affidavit.

Hernandez allegedly punched the brother in the face. Hernandez, police said, then ran to the kitchen, got a knife and then headed to the bedroom where the brother had retreated. Holding the knife above his head, Hernandez allegedly threatened to kill him.

The mother prevented Hernandez from entering her son's bedroom and defused the situation by agreeing to drive him to Allenstown to see her daughter, police said.

Once they were in Allenstown, she dropped Hernandez off at a store and told him she would return with her daughter. Instead, she contacted Allenstown and Manchester police.

Hernandez was later arrested at his Lake Avenue home.

Hernandez told investigators he and the teenage girl began dating when she was 13 and started a sexual relationship five months ago. He said they used no protection the last two times they had sex because he was trying to get her pregnant, according to court records.

He is being detained on $32,000 cash/surety bail. A probable cause hearing is Aug. 30 and a trial, Nov. 1.

PORTSMOUTH — An illegal alien wanted by the Department of Homeland Security for deportation waived his right to a probable cause hearing on charges alleging he sexually assaulted a minor girl in a Water Country wave pool.

Marvin Hernandez, 27, of 11 Ingall St., Lynn Mass., was brought from the Rockingham County House of Corrections to Portsmouth District Court August 14 on a felony count of criminal restraint, a felony charge of false imprisonment and two class A misdemeanor charges of simple assault.

His waiver moves the charges to Rockingham County Superior Court, where they will likely be heard by a grand jury.

Following Hernandez’s waiver, Judge Sawako Gardner ordered that bail remain at $75,000 cash and $20,000 personal recognizance.

INDIANTOWN — A 52-year-old illegal immigrant has been arrested and charged with sexual battery on a child after allegedly molesting a 6-year-old boy, according to Martin County Sheriff’s Office reports.

Ruben Hernandez-Juarez, who lived in the 15800 block of Southwest Osceola Street in Indiantown, was arrested Tuesday for the alleged incident, which occurred on Sunday, according to reports.

The arresting detective requested Hernandez-Juarez be held without bail because he is an illegal resident.

Man Arrested for Sexually Assaulting Children at a Thai Temple

According to a recently published Los Angeles Police Department press release, a man who was once employed as a photographer and a janitor at a Los Angeles Thai temple has been arrested by police officers for sexually assaulting a total of 7 children who attended a summer school program at the temple.

The arrest happened back on July 31, 2007 at around 11:40 in the afternoon. The man, Chalearmchai Nopthaisong, the 41-year-old janitor and photographer, was arrested on charges of Kidnapping and Lewd Acts on a Child. As previously stated, the suspect was employed as a janitor and photography for the Thai Temple in North Hollywood.

Los Angeles Police Department investigators learned about the assaults when one of the temple's summer school students, a girl of about 7 years old, told her mother that Nopthaisong has grabbed her, locked her in a room of the temple, and took inappropriate pictures of her body. The victim's mother did not take it lightly as she immediately told the Thai Temple Head Monk, as well as the Los Angeles Police Department.

What the Los Angeles investigators found was shocking. The 7-year-old was not the only supposed victim of the suspect. Investigators discovered that there were six additional victims, ages ranging from 4 to 8 years old. Police still believe there may be even more victims out there who have not been identified or have come forth about their abuse or abuser.

Currently, Nopthaisong is being held in police custody. His bail has been set at $9 million. Nopthaisong has not been able to pay his bond, so he will remain in local police custody. Police also discovered that the said suspect is an immigrant of Thailand as well. The Los Angeles District Attorney has not announced his trial date to the press at this time.

Despite the suspect being held in police custody for the said charges, Los Angeles police and investigators are still searching for information about Nopthaisong. Investigators believe that there may be more victims out there, so they're urging anyone who may have been abused or anyone with information regarding the suspect or this specific case to contact Officer Alma Mercado at the Los Angeles Police Department, Juvenile Detectives, Sexually Exploited Child Unit at 213-485-2883. On weekends or during off-hours call the 24-hour toll free tip line number at 1-877-LAWFULL (529-3855).

Police have also released Chalearmchai Nopthaisong's mugshot, hoping that it will help people identify him or come forward with more information.

ROCKVILLE, Md. -- A Liberian immigrant who had child rape charges against him dismissed because of the difficulty finding an interpreter was back in court Monday, and may face new legal troubles.

There was community uproar when a Montgomery County judge dismissed the rape charge for failure to give 23-year-old Mahamu Kanneh a speedy trial.

The judge and defendant both got hate mail. Kanneh moved back to Philadelphia, and then failed to show up for an appeal hearing, prosecutors said.

He was extradited back to Maryland, where prosecutors argued Monday that Kanneh should be held without bond pending their appeal to reinstate rape and sexual assault charges. Kanneh had been charged with raping a 7-year-old girl and molesting an 18-month-old girl in a Gaithersburg apartment.

An interpreter who speaks Vai, a West African dialect, was in court to assist Kanneh's public defender. The defense attorney successfully argued that it is unfair to jail Kanneh without knowing how long the prosecutor's appeal might take.

She pointed out that prosecutors had previously offered Kanneh a plea deal that would not have resulted in jail time.

"There was an offer of no jail time on misdemeanor charges," public defender Theresa Chernosky said. "So had he taken that he would have been out there anyway. So [for] them to say that he is a public risk is not really true."

Kanneh was ordered released on his personal recognizance, with special conditions that he report to pre-trial services, reside in Montgomery County, surrender travel documents and stay away from children.

But prosecutors had a surprise to ensure he's not released into the community -- at least not yet.

"A detainer was lodged against Mr. Kanneh by immigrations and customs," Montgomery State's Attorney John McCarthy said.

Kanneh will remain jailed pending a hearing to determine his immigration status, McCarthy said. His lawyer says he is here legally.

Prosecutors said their appeal attempting to reinstate child rape charges against him will be argued in February.

Attempted Kidnapping of 5-year-old Girl

A 5 year old McAllen girl is safe tonight after being kidnapped early this morning, through a bedroom window.

Luckily, the girl's mom caught Jorge Alberto Escobar in the act. Family members tackled Escobar and he was arrested by police down the street.

The girl was not harmed.

The kidnapping happened shortly after midnight on the 600 block of Kennedy Avenue, in south McAllen.

Family members were unavailable for comment. But, neigbors say they are relieved that the intruder has been arrested.

"Oh. well yeah. We don't need any pervert, around here," said Jerry Harris. "And that's pretty brazen to go into someone's window and grab ahold of them like that."

Turns out Escobar is someone the family knows. Escobar is an illegal immigrant who was living in an adjoining room and who worked with the victim's father.

He's charged with aggravated kidnapping and his bond is set at half a million dollars.

The case remains under investigation

4-YEAR-OLD RAPED

BRYAN COUNTY, Okla. -- Durant Police are looking for 25-year-old Jose Retana, a man they say raped a four-year-old girl.

Police responded to the call late Tuesday night after the child was taken by her parents to the Medical Center of Southeastern Oklahoma.

She was then transported to Texoma Medical Center in Denison for a sexual assault examination.

"We attempted to locate him today, and we've been unable (to). Our last information is that he was seen with his sister, Laura Retana in a tan Chevrolet Tahoe, and again, is wanted for questioning in the rape and instrumentation of a minor," said Lt. Johnny Rutherford of the Durant Police Department on Wednesday.

They say they don't know where he is, and that he may be headed back to Mexico.

Franklin man charged with rape, sexual abuse

A man who authorities say is an illegal immigrant has been charged with rape and sexual abuse.

Officials with the Franklin County Sheriff's Office said 38-year-old Alvaro Vargas, 203 Califas Road, Russellville, was arrested Monday and charged with first-degree rape, first-degree sexual abuse and second-degree criminal possession of a forged instrument.

Investigators said Vargas is accused of sexually attacking a 12-year-old girl who was a family friend.

Authorities said the situation has apparently been going on for sometime.

The girl was 11 years old when the incidents took place, officials said.

Officials with the sheriff's department said they were contacted Monday by the Franklin County Department of Human Resources.

Investigators said that after locating Vargas' residence, they set up surveillance for more than six hours before he came home and was taken into custody.

Authorities said once in custody, Vargas, who has been in the U.S. illegally for 26 years and in the Russellville area for the past six years, presented them with a false Social Security card.

Leslie Sawyer, victim's service coordinator with Rape Response, said according to the National Crime Victimization Survey, 67 percent of all victims of sexual assault reported to law enforcement agencies that participated in the survey, were juveniles under the age of 18, and 34 percent of all victims were under the age of 12.

Vargas is being held in the Franklin County Jail on bail totaling $157,500 and is

also being held for U.S.

Immigrations.

Courthouse officials said first-degree rape is a Class A felony, which is punishable by 10 years to life in prison, if convicted. The other two charges are both Class C felonies, which carry a punishment of one to 10 years in prison if convicted.

Two Sex Abuse Suspects Are Illegal Immigrants

OREGON CITY, Ore. - Two men indicted in the rape and sexual abuse of two Oregon City girls have admitted they entered the U.S. from Mexico illegally, police say.

A Clackamas County grand jury indicted two men this week in connection with two Oregon City girls, ages 14 and 15.

Alejandro Hernandez-Flores, 19, of Milwaukie and Mario Alberto Flores-Estrada, 20, of the Los Angeles area are accused of providing Tequila to the girls and having sex with them.

Hernandez-Flores was charged with forcible rape, sodomy, sexual abuse and unlawful sexual penetration. Flores-Estrada was charged with rape, sexual abuse and furnishing alcohol to minors.

Neither man appears to have a criminal history in Oregon, but Hernandez-Flores has some past traffic-related violations, including driving with a suspended license and driving without a license plate.

The men told police they are cousins.

A trial on the Clackamas County charges is scheduled for Oct. 5. At the conclusion of that case and resulting penalties, the men will be turned over to federal authorities for possible deportation.

Hernandez-Flores met the girls a few years ago at Clackamas Town Center, officials say.

An Oregon City officer found them about 2 a.m. Aug. 7 at Gardiner Middle School. The girls, also cousins, allegedly left home without permission and went there with the suspects.

HURON -- A man suspected of being an illegal alien was charged with gross sexual imposition after he was accused of entering an apartment and lying down next to and touching the thigh of a sleeping 8-year-old girl, according to Huron police.

Lucio Sanchez-Martinez, 32, also was charged with entering the apartment where the girl lived with her father and two other children, said Huron police Chief Randy Glovinsky.

Huron police began investigating the morning of Aug. 8, when they received a call for a sex offense investigation, according to the police report.

When officers arrived at an apartment building in the 600 block of Cleveland Road about 9:30 a.m., they found Sanchez-Martinez and the girl's father had gotten into a physical altercation, the report said.

The girl told police she was sleeping and awoke to find a man lying next to her and rubbing her thigh, Glovinsky said. The girl said the man pretended to be asleep but had a smile on his face, according to the report.

The girl went into another room and told her father who then left the apartment to confront the man, Glovinsky said.

The father found Sanchez-Martinez and said Sanchez-Martinez threw a punch at him, according to the police report. The father told police he ducked the punch, then punched Sanchez-Martinez in the face and threw him down a flight of stairs. Sanchez-Martinez suffered slight injuries, but the father was not charged in the incident, Glovinsky said.

Sanchez-Martinez did not live in the building, but apparently was visiting someone there, Glovinsky said.

He did not know the family and entered the apartment through an unlocked door, the chief said.

''The guy has no reason to be in that apartment whatsoever,'' Glovinsky said. ''They didn't know him. He just walked in.''

It was unclear if drugs or alcohol were a factor in the incident, Glovinsky said. Police contacted immigration officials and found Sanchez-Martinez is an illegal alien who has been deported at least once, Glovinsky said.

Sanchez-Martinez is due in Huron Municipal Court Friday for a preliminary hearing, according to court records. He is being held in the Erie County Jail.

Man Charged With Kidnapping, Trying To Sexually Assault Young Girls in Gaston County

GASTONIA, N.C. — Police in Gaston County say an illegal immigrant kidnapped and tried to sexually assault two little girls Saturday.

They say Ramon Zamora-Solano, 41, told the girls to come into his apartment in Gastonia. The 6- and 5-year-old girls were playing outside at a birthday party on Duhart Avenue. Police say the girls said no, and Zamora-Solano hit them and dragged them into the apartment by their hair before locking the door.

The girls’ parents went looking for them, and found them in the apartment. They say Zamora-Solano’s pants were open, and one of the girls’ dresses was pulled up. The girls’ fathers attacked Ramon Zamora Solano, leaving him bruised.

Zamora-Solano told a judge Monday he wanted to explain his side of the story. But the judge told him to talk to his lawyer first.

Judge Tells Illegal Alien He is "Unwelcome Undesirable"

General Sessions Court Judge Bob Moon said the man charged with setting a fire in a downtown hotel is "an unwelcome undesirable" illegal alien.

Judge Moon told Bario Gomez, "Undesirables like you are not welcome in this country. You are a Latino terrorist who entered this country illegally and soon plotted significant personal injury and damage to the people and businesses in our community."

Authorities said Gomez is an illegal alien with no proof of identification. Officials also said he gave police a false name.

The INS placed a hold on Gomez, 20, after charges of aggravated arson and aggravated vandalism were filed against him.

Judge Moon told him, "It is undesirables like you who create many unjustifiable problems and prejudices upon the good people who enter this country legally in chasing a dream for a better life for themselves and their families.

"Mr. Gomez, you nor any other citizen from a foreign land has a right to enter this country; you simply have a privilege to enter this country through the proper legal channels.

"You are a domestic terrorist who is an imminent threat to the safety of our people and their property. You are also a supreme flight risk from justice. It is with duty, comfort and ease that I increase your bond significantly in an appropriate amount to insure your appearance in further proceedings and to insure the safety of this community."

The bond was raised from $30,000 to $1 million. The previous bond was set by Magistrate James Purple, which Judge Moon described as "another ludicrously low bond."

According to Arson Investigator James Whitmire, Gomez checked into the hotel with his girlfriend. Testimony by Whitmire and management officials indicated that Gomez placed a toaster filled with matches in a microwave oven in his room intending a massive "delayed burn."

Proof also showed that multiple towels were stuffed into the toilet in order to retard the water supply. The hotel manager testified that the towels were stuffed so deeply that the pipes had to be disassembled to remove them. She also stated that the room was severely damaged and vandalized.

Capt. Whitmire testified that "hundreds of people were evacuated, including children."

He said, "If the fire had established itself many families and children would have most likely lost their lives or been severely injured. Being on the fourth floor, the fire would have been difficult to contain."

Mother Interrupted Assault In Child's Bedroom, Police Say

INDIANAPOLIS -- Police said a woman interrupted a 19-year-old man's rape of her 5-year-old daughter and, with the help of her son, held him in her home until officers arrived early Friday morning. According to police, Jesus Valenzuela (pictured) entered the home, located in the 6000 block of Sunwood Drive on the city's northwest side, and raped the girl in her bedroom. The girl's mother told police that she awoke at about 4:30 a.m. and found the home's patio door open. When she went to check on her children, she found Valenzuela raping the 5-year-old, police said.

Police said the woman pulled Valenzuela off her daughter and yelled for help from her 13-year-old daughter, who was asleep in the same bedroom, and her 18-year-old son, who also was asleep in the home. The 13-year-old called 911, and the son arrived to help his mother, police said. "Of course, the suspect is trying to get away. The 18-year-old son arrives, and they're able to subdue (Valenzuela) and hold him there for the police to come and get," Indianapolis police Sgt. Matt Mount said. Police said Valenzuela refused to answer investigators' questions, 6News' Jack Rinehart reported. They said he is a Mexican national who may be in the U.S. illegally. Authorities said they found property that belonged to the children in Valenzuela's pockets. Police said that in the home, they found items that they believe Valenzuela dropped after stealing them from a vehicle down the street. Dr. Gene Rogers had a pretty good idea of what was coming when he saw his supervisor and a county security officer arrive at his office door. His supervisor was holding paperwork; the security guard was holding an empty box.

Dr. Gene Rogers knew what they had come to do, and why they were doing it. As the medical director for Sacramento County's Indigent Services program for the better part of the past decade, Dr. Rogers has waged a long fight against the central California county's practice of providing non-emergency medical care to illegal immigrants — a policy he says violates federal law and results in the poorest American citizens being denied the care they deserve.

That fight cost Dr. Rogers his job. In a two-sentence memo to Dr. Rogers, the county's Health and Human Services director, Lynn Frank, informed him that he was fired, but thanked him for his services. No reason for his termination was offered, but then he didn't really expect one. "Sacramento County knowingly violated state and federal laws, misappropriated taxpayer revenues and diverted funds designated for indigent citizens to pay for services delivered to illegal aliens," Dr. Rogers said. "And they did so even as they cut the budget."

Fired earlier this month, Dr. Rogers is the latest casualty on a frontline in the struggle over illegal immigration that's often overshadowed: the battle that has simmered throughout government agencies. Many government employees remain silent in the face of what's happening — fearful for their jobs and perhaps doubtful that they would make a difference. But Dr. Rogers, a Vietnam veteran, felt compelled to become a conscientious objector to the status quo.

The local cost of the medical treatment provided to illegal immigrants is small when contrasted to the billions of dollars the state and federal governments spend every year on the "undocumented," but the numbers have grown dramatically. According to county health officials, the hundreds of illegal immigrants who were being treated through the indigent program in the mid-1990s have now grown to thousands of people, with the annual cost to taxpayers swelling into the millions of dollars.

Ironically, when Dr. Rogers, 67, took the position of medical director for the indigent services program back in 1999, he arrived in the Central Valley with hardly a clue (let alone an opinion) about illegal immigration and its impact on social services. He had one goal: to provide the best care possible for those who need it most.

As the years went by, however, that egalitarian perspective began to be tinged with cynicism as he watched poor citizens get squeezed out of the system even as illegal immigrants gleefully manipulated it, all while bureaucrats facilitated the rampant violations of the very laws they were entrusted to enforce.

"I've seen cases and case histories of patients who essentially have come up from Mexico for the express purpose of being treated here, and then leaving to return home," Dr. Rogers said. "I've watched illegal immigrants brazenly demand free, non-emergency health care that was meant for our poorest citizens. I've heard them and their families complain. They feel entitled to it." Dr. Rogers filed a lawsuit in 2003 after county officials "stonewalled" him when he questioned why they were cutting budgets while still providing non-emergency medical treatment to people who have no legal right to be in the country.

The lawsuit is currently under appeal in federal court, but its impact was felt in the state capital, causing a nervous Latino Legislative Caucus in California last year to push through a bill by state Sen. Deborah Ortiz that explicitly allows counties to "opt" to provide non-emergency medical care to illegal immigrants. Sacramento County also responded, Dr. Rogers said, by seeking to alienate him from his prior relationships with county medical staff and by methodically preparing to fire him — with a little humiliation thrown in along the way. On one occasion, Dr. Rogers said, he was forced to sit through a staff meeting in which his supervisors asked case-management nurses one by one if they had any issues or problems with him. None said they did, but it was a humiliating experience.

"I am concerned that you continue to focus on patients' immigration status," Program Manager Nancy Gilberti said in a negative work review, "which is outside your and [the] program's purview." Mrs. Gilberti's remarks reflect a prevailing culture that has emerged in government: a culture that will not tolerate anyone who dares to draw a distinction between American citizens and illegal immigrants. It is a culture that now pervades police departments, public schools and universities, social services and health care.

But when someone like Dr. Rogers speaks up to question the impact on citizens of such allocation of funds for health services like those in Sacramento, the response is clear: Sit down and shut up — or else.

But considering that a young Dr. Rogers started his medical career trying to save the lives of horrifically wounded American soldiers in the jungles of Vietnam, Sacramento County's apparatchiks picked the wrong target this time. For Gene Rogers himself, his crusade is deeply rooted in those grim battlefields he found himself on more than 30 years ago. He watched young men fight and die, men who sacrificed all for the very distinction that citizenship brings to Americans.

It's a distinction that Sacramento County and so many others may choose to ignore, but for Dr. Rogers, that loyalty is a sacred trust he is determined to keep.

Camden sheriff picks up pair after baseball-bat wielding neighbor runs them off

CAMDEN COUNTY - Two men are being held for deportation after threatening a Sunrise Beach resident.

On Tuesday at approximately 4:30 p.m., the Camden County Sheriff's Department responded to a call of a reported assault in Sunrise Beach.

When deputies arrived, the female victim said she had been assaulted by two Hispanic men who she said also threatened her if she called authorities.

Jose Paniagua Avalos, 19, and Jose Guadalupe Delacruz, 26, had fled the scene before deputies arrived.

According to the sheriff's department, a neighbor of the victim who had witnessed the assault had forced the men to leave by threatening them with a baseball bat.

Deputies were able to locate the men a short time later and took them into custody without incident.

Avalos is being held on one count of third-degree assault and a federal hold from U.S. Immigration and Customs Enforcement, while Delacruz is being held on a warrant from Jackson County, Mo., charging him with driving with a revoked license. He also is being held for ICE.

Both men are originally from Mexico but, until yesterday had been living in Sunrise Beach.

12 Year Old Girl Raped & Suspect Is HIV Positive

(Alabama) - 32 year old Julio Cesar Cruz Martinez sits in a Baldwin County jail charged with rape, sodomy and sex abuse. Alleged crimes involving a young girl under twelve years of age.

During an interview, investigators say Martinez dropped a bomb on sheriff's deputies and the victim's family. A revelation that has compounded this tragedy.

Sgt. Tony Nolfe of Baldwin County's Sheriff's Department says, "he did confess to several of those acts. Later in the afternoon, he did
disclose to jail personnel that he was HIV positive and the health concerns for the victim are being addressed."

There's another twist to this case. Sheriff's deputies say Julio Martinez may not be the man he say's he is. "Mr. Martinez is apparently an illegal alien. His identity is somewhat still
in question. We have not been able to confirm his identity or certain facts about his back ground" says Sgt. Tony Nolfe.

Investigators say the victim, the victim's mother and the mother's fiancee had been living with Martinez for the last few months. Investigators say Martinez has been living in the Fairhope area for the last two years.

Driver facing murder charges in officer's death

The man accused of being drunk behind the wheel of a sports car that killed a Flint police officer was arraigned Tuesday on charges that included second-degree murder.

Ramon Felix Pineda stood mute in 52-2 District Court before Judge Kelley Kostin, who denied bond based on the severity of the charges and his status as an illegal resident of the United States. "I don't find any comfort the bond would give Mr. Pineda the conviction to show in court," Kostin said.

Pineda is alleged to have been illegally living in the United States for the last 10 years under false identities, including a cousin who lives in Mexico. He is being charged with seconddegree murder, operating while intoxicated causing death, leaving the scene of an accident causing death and driving with a suspended license.

Second-degree murder carries a maximum of life in prison, while operating while intoxicated causing death is a 15-year felony.

Officials with the U.S. Immigration and Customs Enforcement have also been informed of Pineda's illegal citizen status.

The 25-year-old is accused of being behind the wheel of the 1992 Chevrolet Camaro that hit off-duty Officer Vincent Owen D'Anna about 8 p.m. Sunday on Sashabaw Road, just past Clarkston Road.

According to witness statements, the Camaro was heading south on Sashabaw Road and hit D'Anna from behind.

D'Anna was driving a 2007 Suzuki motorcycle and became pinned under the car.

The Camaro continued heading south after the collision, dragging D'Anna several feet, according to witnesses.

Oakland County Sheriff 's deputies say Pineda got out of the Camaro and tried to run away, but a witness stopped him.

Oakland County Sheriff 's Lt. James Ahearn told the court Pineda admitted to drinking seven beers before getting behind the wheel of the Camaro and was driving too fast to slow down.

Ahearn also told the court Pineda gave them several false identities. Oakland County Assistant Prosecutor Kelly Chard said Pineda has two bench warrants out of that district court dating back to 2001, stemming from traffic violations.

Pineda has also never applied for a driver's license, and there were at least 16 witnesses who saw him hit D'Anna, Chard said.

"I think the only way to protect society is to deny bond," she told the court.

Defense attorney Arthur Greenstone asked for leniency on the bond, saying Pineda and his family are heartbroken over what happened.

Pineda didn't mean to hurt anyone, but only wanted to run from the scene because of his illegal resident status, Greenstone told the court.

He has also been employed for the last five years as a cook at a Clarkston restaurant, Greenstone said. Members of D'Anna's family left the courtroom as Greenstone continued to ask for leniency on setting his bond.

"His 1-year-old son and his wife are here. I It appears this is a one-time incident, and it is awful, but there is no history of substance abuse or violence," Greenstone told the court. "If you scratch this catastrophe, you will find someone who has been a productive member of this community."

Visitation for D'Anna will take place 6-9 p.m. today and 3-5 p.m. and 7-9 p.m. Thursday at Lewis E. Wint & Son Funeral Home, 5929 S. Main St. in Clarkston. The funeral service will be held at 10 a.m. Friday at Clarkston United Methodist Church, 6600 Waldon Road.

Illegal Immigrant Charged In Child’s Death

Charges are filed in the kicking death of a Coweta toddler. Michael Hernandez was in a Wagoner County district court Wednesday, facing first degree murder charges. He's accused of kicking his girlfriend's 2-year-old son to death. A judge denied Hernandez bond, but the victim's family is concerned his immigration status could change that, because he’s here illegally from Mexico. The News On 6’s Ashli Sims reports the victim's grandmother says she's worried he might be sent back to Mexico before justice can be served.

Kelynn Byrd's grandmother says burying her 2-year-old grandson was the hardest thing she ever had to do.

"He is, he's very beautiful and he was so sweet," said Kelynn’s grandmother Michelle Ebel.

The toddler's life was cut short when he died from blunt chest and abdominal trauma. Police say his mother's boyfriend, Michael Hernandez, was the only one home at the time of the boy's injury. And they say Hernandez confessed to repeatedly kicking Kelynn in the chest.

"Whatever kind of anger that can lead up to someone doing that to a 2-and-a-half-year-old boy is just beyond me," said Ebel.

Hernandez is charged with first degree murder and is now behind bars in the Wagoner County jail. The judge in the case contacted the Mexican consulate, because Hernandez is a Mexican citizen, here illegally. Kelynn's family is afraid that Hernandez could be sent back to Mexico before the American legal system can run its course.

A spokesperson from the Wagoner County district attorney's office told The News On 6 they would fight any extradition or deportation. He says they plan on proceeding to a conviction, and if Hernandez is convicted they intend for him to serve his sentence in Oklahoma.

U.S. Immigration and Customs Enforcement, or ICE, confirms that illegal immigrants would go through the same criminal justice process as anyone else. ICE says they do flag illegal immigrants in state custody, so if they're eligible for bond, they're released into ICE custody instead of back into the community. ICE also added if Hernandez was tried and convicted for the murder of Kelynn Byrd he would serve his sentence first, and then be deported back to Mexico.

Michael Hernandez will be back in court next month for a preliminary hearing.

Judge Tells Illegal Alien He is "Unwelcome Undesirable"

General Sessions Court Judge Bob Moon said the man charged with setting a fire in a downtown hotel is "an unwelcome undesirable" illegal alien.

Judge Moon told Bario Gomez, "Undesirables like you are not welcome in this country. You are a Latino terrorist who entered this country illegally and soon plotted significant personal injury and damage to the people and businesses in our community."

Authorities said Gomez is an illegal alien with no proof of identification. Officials also said he gave police a false name.

The INS placed a hold on Gomez, 20, after charges of aggravated arson and aggravated vandalism were filed against him.

Judge Moon told him, "It is undesirables like you who create many unjustifiable problems and prejudices upon the good people who enter this country legally in chasing a dream for a better life for themselves and their families.

"Mr. Gomez, you nor any other citizen from a foreign land has a right to enter this country; you simply have a privilege to enter this country through the proper legal channels.

"You are a domestic terrorist who is an imminent threat to the safety of our people and their property. You are also a supreme flight risk from justice. It is with duty, comfort and ease that I increase your bond significantly in an appropriate amount to insure your appearance in further proceedings and to insure the safety of this community."

The bond was raised from $30,000 to $1 million. The previous bond was set by Magistrate James Purple, which Judge Moon described as "another ludicrously low bond."

According to Arson Investigator James Whitmire, Gomez checked into the hotel with his girlfriend. Testimony by Whitmire and management officials indicated that Gomez placed a toaster filled with matches in a microwave oven in his room intending a massive "delayed burn."

Proof also showed that multiple towels were stuffed into the toilet in order to retard the water supply. The hotel manager testified that the towels were stuffed so deeply that the pipes had to be disassembled to remove them. She also stated that the room was severely damaged and vandalized.

Capt. Whitmire testified that "hundreds of people were evacuated, including children."

He said, "If the fire had established itself many families and children would have most likely lost their lives or been severely injured. Being on the fourth floor, the fire would have been difficult to contain."

Woman allegedly raped in St. Paul as bystanders look on

A 26-year-old man was charged Thursday for allegedly raping and beating a woman in an apartment hallway -- an incident apparently witnessed by several people who did nothing, police say, to help the alleged victim.

Charged with two counts of rape, Rage Ibrahim turned himself in to Ramsey County authorities Thursday afternoon.

"Ibrahim is innocent of rape he said," says Omar Jamal with the Somali Justice Center, speaking on behalf of Ibrahim

It all started Tuesday morning at a Saint Paul apartment complex. According to the criminal complaint, police responded to a call of intoxicated people in the hallway. When they arrived, they found Ibrahim and a 26-year-old woman, both naked from the waist down. The woman told police she was drugged and raped. Police say the alleged attack was captured by the building's security camera.

"It shows the suspect striking the victim," says St. Paul Police spokesperson Tom Walsh.

And police say the tape also shows something else - as many as ten people who saw the alleged attack, but did nothing.

"They simply walked down the hall and turned back.ducked back into their doorway," says Walsh.

Police say the alleged assault lasted 30 minutes and no attempt was made to help the woman and there was no immediate call to 911.

"Clearly people observed what was going on, but for whatever reason chose not to call police," says Walsh.

Psychologists say the reason may be found in the human thought process. It's called the bystander effect. John Tauer teaches social psychology at the University of St. Thomas.

"The more bystanders that are around, the less likely any one is going to help. If 50 people are in a crowd, each one feels little responsibility," says Tauer.

And often times Tauer says, people may be afraid to step in or are confused about what they've seen.

"People look to others for cues and they say is this an emergency? Now, by all accounts it seems that was pretty clear, yet as people look around in these situations and you see other people poking their heads out, you sort of think well, if he or she is not coming out of their apartment, maybe it's not an emergency," says Tauer.

Professor Tauer says psychologists have studied this behavior for years. They say it's not an unusual human response.

Psychologists often point to the case of Kitty Genovese who was murdered outside her New York apartment in 1964. More than 30 people watched it happen, but no one stepped in or called for help right away.

In the Saint Paul case, police say when someone finally called them no one said anything about a rape in progress.

The call came in as a disturbance, intoxicated people in the hallway. That kind of call is a lower police priority than calls about violent crime.

Man charged in 2006 hit-and-run that killed jogger

PORTLAND, Ore. - Exactly one year after a jogger was hit and killed by a driver in the Columbia River Gorge, detectives arrested a suspect they had been following for months.

Rocendo Rosales-Corona, 25, was arrested in Lodi, Calif., on Saturday, according to the Multnomah County Sheriff's Office.

Kimberly Powell, 23, died of her injuries after the wreck, which occurred July 14, 2006.

The driver did not stop to help the injured woman but instead drove away, leaving behind the car's sideview mirror and plenty of questions.

"I was thinking that it was going to be one of those unsolved cases," said Kimberly's mother, Janet Tremain. Kimberly is pictured below.

For months, Kimberly's family had tried to research the case themselves and worked to set up a reward.

Janet and step-father Allen Tremain learned of the break in the case this weekend, as they were camping with their church. When they returned to their RV in the evening, the couple saw 11 missed calls on their cell phone, three of which came from the detectives. When they called the detectives back and heard the news, Janet was overjoyed.

"It was a loud scream throughout the campground sort of thing," Janet Tremain said.

Sheriff's officials lauded the work of Detective Jay Pentheny and Gresham Police Detective Jason Servo, who spent hundreds of hours on the case.

According to the sheriff's office, the detectives received a tip from an informant in October that led them to a vehicle believed involved in the hit-and-run.

The informant, who was from the southwestern U.S., also gave them information that led them to finger Rosales-Corona as a suspect.

Deputies said he is a resident of Mexico who was working at a farm in Oregon at the time of the wreck. They said he moved back to Mexico after the crash then decided to come back to California a few weeks ago to find a new job.

The detectives heard that Rosales-Corona may be in California so they flew to Lodi on Friday to track down new leads. The detectives were nearly out of options Saturday when they decided to follow one last tip, which led them to a store. The sheriff's office said the detectives saw Rosales-Corona go inside, so they waited anxiously as he went into the shop.

"When he came back out, the detectives approached him, identified who they were, and before they said anything else, he just hung his head and said, 'I know who you are,'" said Lt. Jason Gates, a sheriff's office spokesman.

Kimberly's mom and step-dad, pictured above, mourned their daughter on Saturday while marking the one-year anniversary of her death. They received comfort from their church, however. Janet Tremain said on Saturday she was baptized hours before she learned Rosales-Corona had been caught.

"I have been baptized before, but it was within me to be baptized again and re-dedicate myself on the one-year anniversary," she said.

With the arrest, she said, she feels comforted.

"I know that he is going to serve some amount of time, and that he is not going to be continuing his life, knowing that he got away with something," she said.

Janet Tremain said they prefer to call her daughter McDaniel rather than Powell.

She said her daughter's death coincides with the finalization of a divorce, and McDaniel was her maiden name.

Kimberly's step-dad said a peace has come over the home since the arrest.

"Just the tone of the house, and everybody else has just been uplifted, it's just a different level," Allen Tremain said.

Both parents said they were disappointed that Rosales-Corona was in the country at all and able to work in Oregon.

Authorities said Rosales-Corona has a criminal record in California but specifics were not available.

"You know I'm thinking, if he wasn't here illegally, he never would have been there, and it never would have happened," Janet Tremain said. "But you know, there's nothing that I can do to change that."

Driver who fled fatal-crash scene has drunken-driving conviction

The man accused of running a stop sign and causing a crash this week that killed a 17-year-old Port Washington boy is an illegal immigrant who was convicted in Wisconsin in December of first-offense drunken driving, authorities confirmed Friday.

A criminal complaint charging Eddie Carbajal-Lile with hit and run resulting in death also indicates that he consumed five or six beers before the crash Tuesday that killed Paul Watry.

Prosecutors would have needed evidence such as a blood test showing he was intoxicated at the time of the crash to charge Carbajal-Lile with homicide by intoxicated use of a motor vehicle, Sheboygan County District Attorney Joe DeCecco said Friday.

Carbajal-Lile is believed to have left the accident scene on foot before sheriff's deputies arrived, and he remained at large Friday.

Hit and run resulting in death is a felony that carries a possible 25-year prison sentence.

An arrest warrant has been issued for Carbajal-Lile, 27. The Sheboygan County Sheriff's Department says he may be en route to Mexico. The U.S. Border Patrol has been alerted regarding his status as a fugitive. Carbajal-Lile's last known address is in Fredonia.

He uses a number of aliases, including: Eddie Carbajal; Eddie Lile; Eddie Carbajal-Farvies; Negro Carbajal; Negro Carbajal-Lile; and Negro Lile.

The crash happened about 8:40 p.m. Tuesday at Highway 32 and Highway V in the Town of Lima.

Witnesses told sheriff's deputies that a Nissan Sentra traveling east on Highway V failed to stop at a stop sign and struck a Chevrolet Cavalier traveling south on Highway 32. The Cavalier sustained extensive passenger-side damage, where Watry was seated. Watry died Thursday at Froedtert Hospital in Wauwatosa.

Another passenger in the car in which Watry was riding, Jillian Fitzmaurice, 18, of Oostburg, was treated at Froedtert Hospital and released. The driver, Scot Mueller, 18, of Port Washington, was treated at St. Nicholas Hospital in Sheboygan and released.

Investigators say Carbajal-Lile was driving the Sentra.

According to the criminal complaint, witnesses at the crash scene suggested that Carbajal-Lile lie down and wait for medical help to arrive. He instead retrieved a cell phone from the car he was driving and walked away east on Highway V.

The criminal complaint quotes Gabriel Anzures, who described himself as a friend of Carbajal-Lile's, as saying he had been drinking with Carbajal-Lile at a tavern in the Town of Sheboygan prior to the crash.

Anzures also told investigators that he received two telephone calls from Carbajal-Lile after the crash. In the first call, Anzures said Carbajal-Lile told him that he had hit something with the car he was driving, a 1997 Nissan Sentra.

Online court records indicate that a man using one of Carbajal-Lile's suspected aliases, as well as his date of birth and address, was convicted in January 2004 of having open intoxicants while a passenger in a motor vehicle.

Alejandro Xuya-Sian did more than shred the skin on his victim's body -- he shredded his victim's dignity, making him feel "too embarrassed" by his appearance to face the drunken driver who nearly dragged him to his death, a judge said as he sentenced Xuya-Sian to 3 1/3 to 10 years in prison.

"You didn't just injure him physically. You shattered his life," Suffolk County Judge James Hudson told Xuya-Sian before he imposed his sentence. Hudson said Xuya-Sian treated his victim with less regard than he should "an injured animal."

Xuya-Sian, 27, pleaded guilty last month to vehicular assault, driving while intoxicated, leaving the scene of an accident and other charges.

Suffolk prosecutors said Xuya-Sian struck Anselmo Chin-Sabam, 21, with his 2002 GMC Envoy in the parking lot of a Riverhead bar in April. Chin-Sabam became lodged in the front left wheel of the SUV, and had his skin shredded as Xuya-Sian drove three-quarters of a mile before realizing he was there.

Assistant District Attorney Thalia Stavrides said Xuya-Sian "stopped the car, got out and undoubtedly dislodged him from the car," then kept driving, crashing into a tree about two miles away. Stavrides said Xuya-Sian was arrested with blood-alcohol level of .08 percent, right at the legal limit.

Chin-Sabam suffered first-degree burns on more than 40 percent of his body, multiple fractures and had some parts of his body torn to the muscle, Stavrides said. He is still recovering and was in no condition to be in court Thursday, she said.

Given the opportunity to make a statement before receiving his sentence, Xuya-Sian began speaking when his Legal Aid attorney, Bryan Browns, interrupted him. Browns took him to the side, and then said his client would remain silent.

Browns said Xuya-Sian, an illegal immigrant, had two children and a wife in his native Guatemala and had been working a $450-a week job to help support them.

"He regrets and he takes full responsibility for what happened," Browns said in court. "I think his time in prison is going to allow him to reflect and get on with his life."

Hudson said he would recommend that Xuya-Sian be deported after completing his sentence -- a sentence that Hudson said was "too lenient" because of limitations of law.

"[The sentence] is not enough to give consolation to your victim that this is how such a violation of his body was punished," Hudson said.

Murdered father is laid to rest - Mourners gather for Anthony Senisi funeral

The rain-swept morning did little to hide the rivers of tears that flowed openly Friday as mourners paid their final respects to Brighton Beach murder victim Anthony Senisi.

Dozens of people flocked to Guardian Angel Church, 2987 Ocean Parkway, on August 10 for the moving funeral mass. Those in attendance included Borough President Marty Markowitz and a host of cops from the 68th Precinct in Bay Ridge, who acted as pall bearers.

Senisi’s brother is a cop from the 68th Precinct, mourners said.

But, as the service continued, news that detectives from the 60th Precinct had apprehended Senisi’s killer did little to console mourners.

“You probably can’t put this in the paper, but that guy is a piece of sh--,” Scott Palma of PR Plumbing and Heating said of 19-year-old Meja Cinto, who has been charged with murdering Senisi on the night of August 4.

Police said that Senisi had just bought some milk from a corner store on Neptune Avenue and was on his way home, to the 2850 block of Brighton 6th Street, when Cinto allegedly attacked him.

Despite being stabbed, Senisi managed to stumble home, where he fell into the arms of his stunned father, 77-year-old Anthony Senisi, Sr., who had just gone outside to see why it had taken his son so long to return.

“Daddy, call the police, someone hit me,” the elder Senisi recalled his son saying, barely containing his grief in front of reporters the day after his son died. “He didn’t even know he had been stabbed. But he had blood all over him. I had blood over my arms. I just laid him down and hugged him.”

Senisi died in his father’s arms – right in front of his 11-year-old son -- just moments before paramedics arrived to render aid. Friends and family members said that he spent the day with his wife, celebrating their 17th wedding anniversary. Senisi is also remembered by a teenage daughter.

After a brief investigation, investigators set their sights on Cinto, who police allege may have lashed out against the neighborhood plumber because he himself had been beaten and stabbed during an earlier neighborhood scuffle.

Looking for vengeance, police alleged that he attacked Senisi, who may have been wearing the same Yankee jersey as one of Cinto’s attackers.

Cops described Cinto as a illegal alien and gang member.

Although he had his share of run-ins with police in the past, Brooklyn prosecutors said that he’s never been arrested in the borough before.

As the investigation progressed, cops tracked Cinto down to Hazelton, Pennsylvania, where he was arrested on August 8.

“He [Cinto] should have been deported a long time ago. He had a prior record,” said an outraged Palma who said that Senisi could “always put a smile on your face.”

“He was a great guy,” Palma said of Senisi. “I can’t say enough about how great he was.”

Another mourner said that his older brother was so distraught over the killing that he is thinking of early retirement from the NYPD.

“He doesn’t want to go back to the job,” the mourner said.

Cops from the 68th Precinct reportedly helped collect money to help pay for funeral costs.

Cinto, who has been charged with murder in the second degree and criminal possession of a weapon, was remanded to custody after his arraignment last week.

According to prosecutors, Cinto was seen stabbing Senisi one time in the left side of the torso during an altercation at the corner of Brighton 6th Street and Brighton 4th Terrace. Even the witness, however, could expound upon why he targeted Sinisi, who had nothing to do with the earlier attack.

The stab wound pierced an artery, according to the medical examiner.

Mount Clemens man dies after golf club attack; sheriff to seek murder charges

MOUNT CLEMENS -- What started as an argument between neighbors over a barking dog led to an assault with a golf club that left a 44-year-old man dead, police say.

Steve Tocco of Mount Clemens died Thursday in Mount Clemens Regional Hospital after his neighbor, 22-year-old Alberto Barajas-Enriquez, hit him in the head with a No. 2 driver, Macomb County Sheriff Mark Hackel said.

"We got a 911 call at about 6:50 p.m. Tuesday from the victim, who said he'd been assaulted by his neighbor," Hackel said. "Apparently, they had been arguing for some time about the suspect's dog, that he was barking and (the owner) wasn't picking up after it."

On Tuesday, the longstanding argument between the two residents of the apartment complex on Comet Street turned violent, Hackel said.

"For some reason, Enriquez left his apartment, went outside and grabbed a No. 2 driver," Hackel said. "Then he entered his neighbor's apartment without permission and started swinging the club at him. He hit him several times -- once in the head."

Tocco was transported to the hospital, and Barajas-Enriquez was arrested and charged Wednesday with assault with intent to do great bodily harm and home invasion. Bond was set at $20,000, "but there was also an immigration hold on him, so he was kept in the jail," Hackel said. He added he was not sure whether Barajas-Enriquez was an illegal immigrant.

"Then we got a call (Thursday) that the victim passed away," Hackel said. "An autopsy showed he died of blunt-force trauma to the head."

Hackel said he will seek second-degree murder charges against Barajas-Enriquez.

Terry Funderburk is a businessman. His business is in the construction industry in Columbia, South Carolina. He runs an honest business and is proud of it. According to Terry, however, his business is being put out of business because of companies hiring illegal aliens to do the same kind of work at “slave wages.”

Mad as hell, he decided to do something about it!

American Citizens, we do what we can to make a living, and the government is unwilling to enforce the laws on the books when it comes to an invasion from the south, or to stop invaders from any point of the border as a national security issue, for that matter, which in the long run puts us at risk in so many ways. Heck, certain members of the government even complains that the oil companies are making too much money! Do you know where that profit goes? Stock holders. Folks like you and me investing in stocks so that they can have some kind of retirement since the government has squandered Social Security. Now, folks like Terry can’t make ends meet because the government refuses to enforce the laws on the books.

Do we blame Terry Funderburk for being angry?

Terry is the new image of the American Worker. He took a stand, and was arrested for it. This is no longer a government of the people, by the people, and for the people. This current system is favoring those that are not even citizens with preferential treatment.

Indiantown illegal immigrant arrested on child molestation charge

INDIANTOWN — A 52-year-old illegal immigrant has been arrested and charged with sexual battery on a child after allegedly molesting a 6-year-old boy, according to Martin County Sheriff’s Office reports.

Ruben Hernandez-Juarez, who lived in the 15800 block of Southwest Osceola Street in Indiantown, was arrested Tuesday for the alleged incident, which occurred on Sunday, according to reports.

The arresting detective requested Hernandez-Juarez be held without bail because he is an illegal resident.

IMMIGRANT JAILED IN SEX CASE

Ramirez was arrested Wednesday afternoon in the area of 7200 S. Atlanta Ave., where he was working on a nearby house, according to police records.

He was booked into jail at 5:20 p.m. on a single sexual battery complaint and out standing court costs related to a previous encounter with the law, according to jail records.

Ramirez was charged less than two years ago with first-degree burglary and sexual battery against an adult female in Broken Arrow, said Maj. Mark Irwin of the Broken Arrow Police Department.

But court records show Ramirez was only convicted for trespassing, a misdemeanor.

Records at the time of the 2005 arrest do not indicate an effort was made to determine the immigration status of Ramirez, Irwin said.

Immigration officials said Thursday there was "no record of a 2005 conviction of this alien."

Immigration checks were not done in the Tulsa County Jail, as they are now, when Ramirez was booked there in August 2005, said Chief Deputy Tim Albin of the Tulsa County Sheriff's Office.

The Sheriff's Office took over jail operations July 1, 2005, and did not begin its current practice of checking immigration status until several months later, Albin said.

Ramirez was being held on a $2,717.40 bond.

"He won't go anywhere until his charges are either resolved or he bonds out and is turned over to ICE (immigration officials)," Albin said.

Illegal immigrants convicted of aggravated felonies are subject to immediate deportation after any related prison sentence is served.

Ramirez approached the 16-year-old victim and made inappropriate statements, according to a police report.

Later, the teenager saw Ramirez near a community pool talking with several young boys, the report says.

"The teenager went over to the suspect, at which time the suspect made inappropriate contact with the victim," according to the report.

Guatemalan arrested in crash

Illegal immigrant held in U.S. 29 hit-and-run that killed two road workers

A Guatemalan man who is in the United States illegally was arrested early Tuesday on hit-and-run charges after a traffic accident that killed two Baltimore-area men and injured three other highway construction workers on the side of U.S. 29 in Montgomery County, police said.

The crash just over the Howard County line was the latest in a series of fatal traffic accidents involving illegal immigrant drivers in Maryland. It also added two names to the list of highway workers killed in on-the-job crashes recently.

James Cronin, 37, of the 7200 block of Judy Road in Glen Burnie, was flown to Maryland Shock Trauma Center on Monday in critical condition and died late Tuesday morning, according to Officer Melanie Hadley, a spokeswoman for the Montgomery County Police Department.

The previous day, Martin Ruffin, 30, of the 1800 block of Moreland Ave. in West Baltimore, was pronounced dead at the scene of the 1 p.m. crash. Three others were taken to hospitals with injuries.

Montgomery police said the driver of a white Ford Econoline 150 fled on foot after plowing into a construction truck and hitting the workers, who were sitting on a guardrail taking a break.

Manuel De Jesus Gonzalez-Geronimo, 31, of Hyattsville turned himself in to Prince George's County police about 12:30 a.m. Tuesday, authorities said.

Gonzalez-Geronimo was turned over to Montgomery County police and charged with failure to remain at the scene of a collision involving death and bodily injury and with driving without a license, police said. At a hearing Tuesday, he was ordered held without bond at the Montgomery County Detention Center.

Lucille Baur[CQ], another Montgomery police spokeswoman, said that Gonzalez-Geronimo said during the hearing that he is an undocumented worker from Guatemala.

The crash was one of several recent fatalities in Maryland for which illegal immigrants face charges.

In May, 20-year-old Mark Watson, a University of Maryland sophomore from Ellicott City, was killed in a hit-and-run crash in College Park. Police charged Never L. Navar ro-Montoya, 24, an illegal Mexican immigrant who had no driver's license, with driving under the influence of alcohol, fleeing the scene of an accident and possessing a false government identification.

In November, Eduardo Raul Morales-Soriano, an illegal Mexican immigrant who lived in Laurel, was indicted on charges of manslaughter and negligent homicide while under the influence after a Thanksgiving night crash at Routes 175 and 108, records show. Jennifer Bower, 24, of Montgomery County and Marine Cpl. Brian Mathews, 21, of Columbia were killed. The trial is set for Sept. 18.

Monday's accident also provided a grim reminder of the dangers of working on Maryland's highways.

In June, State Highway Administration worker Richard W. Moser, 57, was struck and killed by a pickup truck while leading a maintenance team sweeping the shoulder of a highway ramp near Frederick.

Eight days earlier, Baltimore prison inmate James Morton-Bey, 27, died while serving on a work crew when a car ran off the inner loop of the Capital Beltway in Prince George's County and struck him.

The five highway workers in Monday's accident were employed by PDI Sheetz Construction Co., according to State Highway Administration spokeswoman Valerie Burnette Edgar. A woman who answered the phone at the Linthicum Heights company said officials there had no comment on the accident.

Burnette Edgar said the company was performing work under a contract with the state. She said that even though they were not state employees, news of the deaths "sends chills down everybody's spine" at the highway agency.

In a typical year, about 1,000 people are killed in work- zone accidents on U.S. highways. Generally, motorists account for 85 percent of the fatalities, while 15 percent -- many of them highway workers -- are non-motorists.

Last year, there were 13 fatalities in work-zone crashes in Maryland, according to the state highway agency. Over the previous five years, the numbers have fluctuated from a low of five to a high of 20.

The injured victims of Monday's accident in Burtonsville were identified Tuesday morning as Jose Padillo, 35, of Glen Burnie, and Columbia residents Hugo Perez, 28, and Rafael Ramos, 30.

A spokeswoman for Washington Hospital Center said Ramos was discharged Tuesday. She said Perez was in fair condition.

Delores Butler, a spokeswoman for Prince George's Hospital Center, said she could find no record of Padillo having been treated there. Montgomery County police were unable to explain the discrepancy but said Padillo had been expected to survive.

A woman who answered the phone at Ramos' home and identified herself as his sister said he had suffered a head injury and was too ill to speak with a reporter.

The accident occurred in Burtonsville in the northbound lanes of U.S. 29, just north of Route 198 near the Howard County line.

Police said the Ford work van went out of control and struck one of three parked trucks on the side of the road. The impact sent the van to the right and into the five workers, police said.

The issue of drivers' licenses for illegal immigrants has become a flash point in many states, including Maryland, where the General Assembly regularly debates legislation that would close the doors of the Motor Vehicle Administration to those who can't prove their legal status. Maryland is one of eight states that issue driver's licenses to foreign-born residents regardless of their immigration status.

Immigrants' rights advocates contend that issuing licenses to illegal immigrants encourages safer driving because it subjects immigrants to testing. But critics of immigration contend that border security comes first.

Family's night out ends in a tragic I-10 wreck
Couple, child killed when car struck by drunken driver, police say

Brandon Brown was driving on I-10 early Sunday when he saw the wreckage that had been snarling traffic for several hours.

"I saw them towing off the van and I saw the other car, but I didn't know what kind of car it was," Brown said. "I gave it no second thought."

Only later would he learn the car was his sister's, and that she, her new husband and her 2-year-old son had died in the flaming wreckage. They were victims, police say, of a drunken driver whose blood-alcohol level was three times the legal limit.

Brown had driven by the fiery site Saturday night, shortly after it occurred about 8:30.

"They had the freeway blocked off. I went all around the accident," said Brown, still stunned after learning what happened.

Family members said Tenisha Williams, 26; her husband, S.J. Williams; and her son, Xavier Brown, 2, were returning from a movie when their Toyota Corolla was rear-ended by a speeding Dodge van in the 8700 block of the East Freeway.

"When (the other driver) hit the car, it hit the gas tank," said Felinda Williams, Tenisha's mother. "She spun out of control. When it was spinning, it burst into flames."

Police said the driver of the van, Juan Felix Salinas, 42, was treated for minor injuries at Memorial Hermann Hospital, where his blood-alcohol level tested at three times the .08 legal limit for intoxication in Texas.

Salinas, who was out on $1,500 bond for a previous charge of assaulting a family member, is facing three counts of intoxication manslaughter, police said.

Witnesses told police Salinas was speeding and rapidly changing lanes just before his van rear-ended the Toyota.

"The guy in the van came around me going fast — I was going like 60 or 70 and he went past me like I was crawling. I told my wife 'Watch that car — he's going to hit that car.' And he did," said Daniel Garcia, who was driving with his wife and three boys.

Garcia, 39, said he pulled onto the shoulder and tried to help Tenisha Williams out of the fiery car.

"She kept saying 'Help me' and I would say, 'Ma'm I'm trying to,' " Garcia said.

He sent his son to collect fire extinguishers from trucks that had pulled over and, along with seven others, tried to extract her by prying doors open and breaking windows.

"The fire was just too hot," Garcia said.

He said he also spoke with Salinas.

"He tried to tell me that she had pulled out in front of him. I said 'You're lying, I saw it all,'" Garcia said. "He was buzzed, his speech was slurred."

Tenisha and S.J. Williams had been married for just over a month, and "she was loving it," her mother said.

"They were in their own little world," Felinda Williams said, calling her new son-in-law "a quiet guy with a smile all the time."

On her MySpace Web site, Tenisha Williams wrote that she was "in love with life and life is also in love with me."

Of her new husband, she wrote, "I never knew I could love someone so hard."

Xavier, known to everyone as "Peanut Butter," was the family's pride and joy, Williams recalled.

"We all loved him," she said, looking at the photographs her daughter posted of Xavier on her MySpace.

She said the family's strong faith will help them endure the pain of their loss.

God, she said, "gives you no more than you can stand."

English-speaker says landlord's message is clear

Tom McKenna is a longtime Stuart businessman who speaks only English.

He says that's why he's being kicked out of the storefront on South Dixie Highway where he has run Seacoast Water Care for seven years.

"I don't know how else to put it," said McKenna, 51.

I'm not sure I do either.

On July 5 — the day after Independence Day — McKenna received a letter from landlord Ivan Munro telling him to consider another location.

Munro said in his letter he wants to have "quality tenants serving the Spanish need in the area."

"I guess I don't serve the 'Spanish need,' whatever that means," McKenna said.

"I have plenty of Spanish-speaking workers come in here to buy water for their landscaping crews," he said. "And people in the neighborhood use the vending machines out front to fill their water bottles for their homes."

The building is on the east side of Dixie Highway, south of Indian Street in Golden Gate. Directly south of McKenna's store, across Southeast Ellendale Street, is a Texaco gas station where men, most of whom speak primarily Spanish, gather to wait for someone to hire them for day labor.

The population of the Golden Gate neighborhood east of McKenna's store also has become mostly Spanish-speaking.

To McKenna, that's irrelevant, as it should be. A customer is a customer is a customer.

But all the signs for the check-cashing store and the Mexican restaurant that share the building with McKenna are in Spanish.

Apparently the signs for Seacoast Water Care don't fit in. They're in English.

Munro pretty much admitted that's one of the reasons he wants McKenna to move.

"I can have a vision, can't I? And his business just doesn't fit there," Munro said. "He's not a good tenant, that's my opinion. He's been late on the rent."

Munro said he had other problems with McKenna: a forklift that was never moved from the front of the store and salt and other supplies in messy piles in an unprotected side yard facing Dixie Highway.

But what Munro said about prospective tenants is the real clincher.

"Mexican people come in, you know they're going to stay. You know they're going to pay the rent," Munro said.

I guess seven years in the same location isn't staying power.

And as far as the rent goes, don't rent to mainly English-speaking guys like McKenna — if you follow Munro's business model.

Munro is a private business owner, and he can do anything he wants with his property including fulfill his "vision."

But there's a double standard, and I don't think Munro is a villain as much as he's the symptom of a bigger societal ill: Try telling a minority business owner to leave so you can bring in a quality tenant to serve the need of the English-speaking population.

You'd have activists organizing protests so quick it'd make the annual snowbird migration seem slow.

Suspect Pleads Not Guilty in New Jersey Students' Execution-Style Deaths

NEWARK, N.J. — A Peruvian national in the U.S. illegally and who was previously charged with raping a 5-year-old girl pleaded not guilty Friday in the execution-style slayings of three young college students, a day after he surrendered to the Newark mayor.

Jose Carranza, 28, aka Jose La Chira, entered his plea before Essex County Superior Court Judge Michael Casale. A second suspect, a 15-year-old boy, has been held pending a detention hearing, and authorities said more arrests were "imminent."

Carranza, of Peru, was being held on $1 million bail. He turned himself in to Newark Mayor Cory Booker after his fingerprints were lifted from a bottle in connection with the shootings of four college students on Saturday. Three were killed but a fourth survived and was hospitalized after the shootings in a Newark schoolyard.

FOX News has learned Carranza, who has a fake Social Security number, had been arrested on charges of raping a 5-year-old girl and then threatening the child and her parents. In that case he faced a 31-count indictment.

In another, he was arrested on assault charges stemming from a bar fight.

Immigration officials apparently were aware of Carranza's illegal status since his prior arrests, according to Essex County Sheriff Armando Fontoura.

Relatives of the victims embraced each other as they entered to watch the hearing.

Carranza's attorney, Felix Montalvo, called Booker on Thursday to arrange his surrender.

“He said, ‘Mr. Mayor, we’d like him to be turned in directly to you,’” Booker said Montalvo, who also is a close friend, told him.

On Wednesday night, police arrested the 15-year-old boy who along with Carranza is accused of murder, attempted murder, robbery, weapons offenses and conspiracy to commit the crime of robbery, Essex County Prosecutor Paula Dow said. Authorities were seeking to have the minor tried as an adult.

Dow said she doesn't believe there is any familial relationship between the two in custody.

The teen, who is Hispanic, is an American citizen with a Newark address, Booker said.

“I don’t think words can describe the level of emotion I feel,” he said of the crimes.

“We will confirm that there are others we are looking for," he said, adding, "I am confident all the suspects in this investigation will be apprehended."

Carranza's attorney, Montalvo, led him by the hand during his surrender.

The sole survivor of Saturday night's shootings, 19-year-old Natasha Aeriel, provided information from her hospital bed after being shot in the head.

Aeriel was with her brother, Terrance Aeriel, 18; Dashon Harvey, 20; and Iofemi Hightower, 20, who were forced to kneel against a wall and were shot execution-style outside a Newark school.

The students had been planning to attend Delaware State University.

Teen murder victim fought back

Court documents are shedding more light on the murder of a 15-year-old Texas girl in a Milwaukie apartment last month. They show that the victim, Dani Jen’e Countryman, struggled with her alleged attackers and that a bloody shoe worn by one of the suspects matched an imprint left on her chest.

Two cousins, Alejandro Emeterio "Alex" Rivera Gamboa, 24, and Gilberto Javier Arellano-Gamboa, 23, are charged with aggravated murder in Countryman’s death. Countryman was found strangled on July 28th at the Balboa Apartments.

According to probable cause documents obtained by Fox 12, Rivera Gamboa said he woke up that morning to find his cousin on top of Countryman. As Countryman struggled, Arellano-Gamboa asked his cousin for help, deputies said.

The documents say Rivera admitted to stepping his foot on Countryman's throat until she stopped moving, Fox 12 reported. As detectives investigated the killing, they found blood on a shoe that matched the size of shoe worn by Rivera Gamboa, authorities said. The pattern of the shoe also matched an imprint on Countryman's upper chest, according to detectives.

The fact that two people were arrested for the killing and that Dani fought back did not come as a surprise to her grandmother, Sandra Wright. “I kinda felt there were maybe two people involved because I don’t think one could have held her,” Wright told AM 860 KPAM in a telephone interview from Texas on Monday night. “She was a little dynamo.”

“We knew she was gonna solve her own case,” Dani’s sister Ashley Countryman said. “I’m glad she put up a fight.”

The two suspects were arraigned in Clackamas County on Tuesday. They are scheduled for a preliminary hearing on Aug. 14th.

“I ordinarily…don’t believe in the death penalty, but I think in this case I wouldn’t have a problem with it,” Wright said. “I’d like to see them suffer. I’d like to see someone strangle them like they did my granddaughter.”

Authorities said Monday it was a bit of a surprise to make these arrests so soon after the murder. They called the investigation “complex” and said it involved a large number of difficult interviews and the tedious collection of critical forensic evidence.

Authorities have said that the two sisters had gone to the Balboa Apartments for a party on the night of July 27th. They separated at some point and spent the night in different apartments at the complex, located at 2717 S.E. Courtney Rd. Ashley Countryman found the body while looking for her sister.

Ashley Countryman lives in Oregon City and her sister was visiting from Texas.

U.S. Immigration and Customs Enforcement has placed a hold on the two cousins, officials said Tuesday. Once they are tried in the criminal system, they will be taken into ICE custody and immigration proceedings will begin against them.

POWAY – A man sexually assaulted a 13-year-old boy near a middle school Monday after luring him to a hillside encampment with alcohol, sheriff's officials said.

Deputies arrested Jesus Mora Nava, 30, in the area later that night and booked him into jail on suspicion of several child molestation charges. His bail was set at $235,000.

He is also being detained on federal immigration violations.

Sheriff's investigators say Nava approached the boy near Meadowbrook Middle School Monday afternoon and led him to a nearby hillside, where it appeared Nava had been camping out.

They said Nava gave the boy alcohol before sexually assaulting him.

Sheriff's deputies were alerted at 3 p.m. shortly after the attack and interviewed the boy at the school and later at a hospital.

Deputies searched for the man, but found the camp empty.

Later that night, a sheriff's helicopter used a infrared camera to detect a heat source in the area.

Nava was arrested after a short chase. Investigators say he was identified based on the victim's statement and help from local businesses.

Man charged with raping 6-year-old

An 18-year-old man accused of sexual contact with his friend’s 6-year-old daughter was charged with child rape and aggravated sexual battery, a Murfreesboro detective reported.

Defendant Jesus G. “Egg” Garay-Barrientos of 1316 Owasa Trail was charged with raping the girl on at least two occasions and fondling her from April through July at the girl’s father’s home, Detective Wayne Lawson reported.

A Department of Children’s Services employee interviewed the girl.

“During this interview, the child disclosed multiple incidents of sexual abuse including touching of her private parts and penetration,” Lawson reported.

Through further investigation, Lawson identified the suspect who was brought to the police department for questioning. Garay-Barrientos denied any contact with the child.

Lawson charged him and booked him into Rutherford County Adult Detention Center where he is being held on $130,000 bond. A hearing is pending in General Sessions Court.

Garay-Barrientos works in construction. He is an illegal immigrant now under investigation by Immigration and Customs Enforcement agents.

It took my Father-in-Law three days to die after the accident. The list of unbroken bones in his body was shorter than the list of broken bones. Three days of which there were no drugs powerful enough to remove all the pain and bring him comfort.

Three days of ticking off the seconds while he prepared to die.

Oh, yeah - I am against illegals. To answer the critics, no, I do not “hate” Hispanics. Not at all. I do bear an intense animosity to the crime, but not to the criminal. FOUR TO 24 YEARS: Trucker gets sent to prison

Driver in November crash that killed four, injured six

A trucker who plowed his tractor-trailer rig into a traffic jam on Interstate 15 last year killing four people and injuring six was sentenced to four to 24 years in prison Tuesday.

Milson Sabino Oliveira Filho, 52, sobbed and his body shook as he talked of his remorse about the crash and said faulty brakes were to blame for the deaths.

"I was about to get off on the Cheyenne exit and at the last minute I decided not to and lost control of my truck," Oliveira, who speaks Portuguese, told Senior District Judge Charles Thompson through an interpreter. "It was a horrible fatality."

Oliveira, an independent trucker, was driving a trailer full of paper pulp from Utah to Southern California about 9:25 p.m. Nov. 16 when he barrelled up behind traffic that had slowed to a crawl in a construction zone on the southbound side of the freeway near Cheyenne Avenue.

Oliveira said his speed was 50 mph, but Chief Deputy District Attorney L.J. O'Neale said investigators estimated it was 60 mph.

O'Neale said he believed fatigue also played a role in the crash.

Oliveira's driving logs were inaccurate, but investigators were able to determine that he had been driving for 7 1/2 more hours than federal regulations allow, O'Neale said.

Federal hours-of-service rules allow interstate commerce truckers to drive up to 11 hours in any 14-hour shift before they must take 10 consecutive hours off.

Oliveira said his brakes failed him.

"I tried to stop the truck by throwing it against the divider," Oliveira said as he wept. "I kept doing that but it wouldn't stop."

Thirteen vehicles were part of the pileup in front of Oliveira's truck.

The collision catapulted the car being driven by Robert Allen Newsted Jr., killing the 31-year-old steel company supervisor. His infant son was strapped into a car seat and survived the wreck.

But everyone in the first vehicle struck by the 18-wheeler died: Arturo Cortez, 69, his wife Estrellita, 64, and their 7-year-old granddaughter Kayla, who was in the backseat.

The truck dragged the Cortezes' car "for more than 100 feet, leaving, I'm sorry to say, body parts in the road," O'Neale said.

Virginia resident and U.S. Air Force member Sarah Hamilton used her jacket to cover Kayla's body, the prosecutor said.

Other Air Force personnel who, like Hamilton, had been driving away from Nellis Air Force Base at the time of the crash, parked a vehicle on I-15 to block the little girl's body from traffic, O'Neale said.

Kayla's father, Arturo Cortez Jr., was in the courtroom for Oliveira's sentencing.

"I have lost both my parents and my only child," he said through tears. "They were the three most important people in my life. I was never given a chance to say goodbye to them.

"The truck he was driving became a weapon. Because of that I will never see my parents or my child ever again."

Cortez and his sister asked for the maximum sentence, which would have put Oliveira behind bars for 14 to 35 years. Cortez said he believed Oliveira chose to violate safety laws.

Gary Foster, a commercial vehicle safety inspector with the Nevada Highway Patrol examined the truck and completed a more than 100-page report, which O'Neale said found the brakes to be "essentially fine."

He said one of the brakes needed adjustment, but that would not have significantly impacted the ability to stop the truck.

Oliveira, a citizen of Brazil, also was in the United States illegally, O'Neale said, adding that immigration officials have no record of him entering the country legally.

But Oliveira said he had been in the country since 2000, legally. He also disputed that on the night of the crash he had been driving longer than allowed under federal law.

Anthony Goldstein, Oliveira's attorney, asked for the sentencing to be delayed because the lawyers defending Oliveira against the lawsuits filed by survivors of the victims had just located the truck and were conducting their own investigation of the truck's brakes.

Goldstein said Oliveira was "a safe driver."

California Department of Motor Vehicles records show that the Oliveira had been on one year of probation after he racked up six violation points against his commercial driver's license, including three convictions for breaking the state's 55-mph speed limit for tractor-trailers.

Goldstein asked for leniency for Oliveira, who has already been jailed for eight months. Goldstein said Oliveira did not have a criminal history and reckless driving is an offense for which defendants can receive probation rather than prison time.

"There's nothing you can do, nothing anyone can do, to bring back their loved ones," Goldstein said. "He's desperately sorry about what he did."

Oliveira pleaded guilty to seven counts of reckless driving in exchange for prosecutors dropping four counts of involuntary manslaughter.

Goldstein asked the judge to allow the victims' families to seek redress in civil court.

At least two lawsuits have been filed against Oliveira, said Lawrence Smith, who is representing the Cortez family in their lawsuit against the truck driver.

Thompson, who was substituting for District Judge Michael Villani, denied the request to delay the sentencing, discounting the claim about the faulty brakes.

"It's pretty obvious to me (that) fatigue was the cause of the accident," Thompson said.

Thompson's sentence was more than the two years in prison recommended by the state Department of Parole and Probation. Thompson said the recommended sentence "neglects the fact that you killed four people."

In communities across America, the immigration conundrum wears a human face.

Its expression can be sometimes fearful, sometimes joyous. On either side of the issue, it’s often determined or resolute.

Here in Cape Coral this week, that face may be symbolized with shock and grief. It can be symbolized by death.

William Lowell, father of three, died on the floor of his garage last Friday, his throat slashed, his arms sliced with defensive wounds, his body stabbed repeatedly.

He began the evening celebrating his son’s 12th birthday with his daughters, 6 and 8, and his wife, Tanya.

He died alone.

The man who has confessed to killing Mr. Lowell, told police he knifed him, called for a ride and went home to shower away the blood before strolling into the Cape Coral Police Department to tell officers he thought he may have killed someone.

Ronnie Perez told police he didn’t call for help, although he knew Mr. Lowell was dying, because he was “scared.”

That may be.

But we’re appalled.

Not because Mr. Perez, an apparent cold-blooded, self-confessed killer is an illegal immigrant, but because he is an illegal immigrant and this is not the first heinous crime of which he’s been accused.

Ronnie Perez, 26, was convicted in 2001 of lewd or lascivious battery on a child younger than 15.

He was sentenced to 20 months in prison and three years probation.

U.S. Immigration did try to deport him after he did his time, but Cuba wouldn’t issue the traveling papers to take him back.

According to OUR laws, if deportation is unlikely, illegal immigrants can’t be held for more than 90 days, no matter their threat to our society.

So Ronnie Perez walked. Walked right on into Cape Coral carrying sex offender baggage. Walked right on into William Lowell’s garage and — by his own words to police— used a knife to take his life.

In Cape Coral today, the face of the illegal immigration controversy is one of failure.

Debate wet foot-dry foot, enforcement vs. amnesty, walls or open borders if you will.

But don’t tell William Lowell’s wife and children the current system and its policies make any sense at all.

Illegal immigrant fled fatal wreck for fear of deportation, police say

GULFPORT — The man police say is responsible for a traffic accident that killed a Saucier couple allegedly fled the scene because he is an illegal immigrant who feared being deported.

Police say Raymundo Rojas Garcia caused Sunday's accident that killed Wayne and Michelle Hughes, who were riding a motorcycle. He fled the scene because he was an illegal immigrant facing almost certain deportation once he was captured, authorities said.

Garcia was attempting to make a left turn in front of northbound traffic on U.S. 49 when he pulled in front of Wayne Hughes' northbound Suzuki motorcycle, a witness said. Hughes tried to get out of the way but it was too late.

The couple's son, who had joined his parents for dinner at a restaurant that night, was in a vehicle behind them and saw the deadly accident.

After the collision, a witness said, Garcia took off running with his wife and 1-year-old son, only to be captured a block and a half away.

He was charged with felony leaving the scene of an accident, driving without a license, driving without insurance, driving with an expired tag and failure to yield. His total bond was set at $51,351.

It is not Garcia's first run-in with the law. Garcia, 27, was charged June 17 by Gulfport police with misdemeanor drunk driving and other traffic violations. He was detained overnight and later fined.

Gulfport Deputy Chief Alfred Sexton said Monday that a hold has been placed on Garcia pending confirmation of his immigration status.

However, Sexton said Garcia admitted to police he was an illegal immigrant. Sexton said Garcia likely would face criminal charges here before deportation.

Harrison County Coroner Gary Hargrove said autopsy results Monday showed Wayne Hughes died of injuries to the head, chest and extremities; Michelle Hughes was thrown from the bike and died of head and neck injuries.

The Tragic, Preventable Death of Alex Tsuji, Age 2: Murdered by an Illegal Alien

On November 18, 2006, our life as we knew it came suddenly and tragically to an end.
I am writing for my son Alex Tsuji, who was born on May 20, 2004 and who died on December 6, 2006. Our car was hit by a drunk driver, Maricio Salazar, if this is his true name. He had a .26 blood alcohol content, three times the legal limit. Mr. Salazar was an illegal immigrant with no insurance or driver’s license. He was drinking and driving when he ran a red light, slammed into our minivan, and put Alex, our 2 ½ year old son, on life support for 19 days. We were shopping for Thanksgiving, and we wanted to buy video games to have an all night video game marathon with the kids. Everyone was very happy that day. Alex picked out his first video game with glee. And he spoke his first complete sentence, “Open for me, mama.”
On the first day at the hospital, the doctors said Alex could not be saved. We prayed for a miracle for 19 days; and we fought to undo what Mr. Salazar had done to him. But doctors, in the US and in Japan, my husband’s native country, confirmed our son was not viable. Alex’s spinal cord was completely transected, and he had a severe brain injury. Alex was in a coma and his body could no longer regulate his breathing or any other bodily function; it was a matter of time and how much suffering, we could not know. No doctor or medical technology could be found to save him. In the end, we, his parents, had to name the date and time of Alex’s death.
We begged every day for God to make our life whole and right again.
Alex is a memory now.
We will never see or hold our son again.
Everyday we miss the sound of his laughter and the mischievous smile on his face, the pitter and patter of his feet, a bit too large for his age.
We miss his joy over a little ladybug or a fluttering butterfly.
We miss his absolute love, his trust that we would keep his little world safe.
A child’s love is given wholeheartedly.
We will never see him grow and become his own person.
We are lonely and the days are long without Alex.
Mr. Salazar has taken away a son and a brother.
On that night, the crash should have never happened. There is no justification. The laws set in place failed us. Mr. Salazar broke American laws in how he came to this country. Mr. Salazar broke American laws in operating a vehicle without a license and without insurance. He also broke American laws in driving drunk and in killing my child. His choices devastated and destroyed our family life.
It took away our security.
It destroyed us financially and emotionally.
We will suffer the loss of our son for the rest of our lives…

Four Illegal Aliens are Jailed on Charges of Raping a Local Woman
Four Mexican men, in the U.S. illegally, are in the Bay County Jail charged with sexual battery.
Cedar Grove police say four illegal immigrants invited two women to what was supposed to be a birthday party at their Cedar Grove trailer Sunday. When the women walked in, they found themselves alone with seven men demanding sexual favors.
One of the women ran out the door, but investigators say the men grabbed the other woman, took her to a bedroom, and pinned her down.

The 20-year-old claims three men held her while a fourth raped her. The woman told police she tried to get back inside to help her friend, but was locked out.
After the incident one of the suspects drove the two women home where they called police. Police say some of the men were so drunk police threw a bucket of water on them to wake them.
Guy Turcotte, Cedar Grove Police Chief, said, "All four subjects were placed under arrest for sexual battery. Their records are being held for INS for questioning and possible deportation, depending on the outcome of the charges filed against them."
The four illegal aliens are all in their early 20s.

Magnolia Police Department Chief Ron Cunningham says his department is seeking information and possibly other victims in a case that has resulted in a charge of indecency with a child being filed against Mauricio Romero Ojeda, 29, a Mexican national.
"We need people to come forward," Cunningham said. "This suspect lived with a local family for several years and other families lived at the same residence during that time."
The charge was filed against Ojeda after he attempted suicide April 29 at a Goodson Street residence where he was living in the city of Magnolia. It was shortly before he severely cut his left arm that the a child under the age of 10 who lived in the home confessed to his mother that Ojeda had committed at least one sexual act with her son. Police believe Ojeda reacted to the discovery with despair and cut himself. Ojeda was arrested on May 1 for indecency with a child, a third degree felony, and taken to the Montgomery County Jail in Conroe where he remains. It was previously reported that there was more than one suspect in this case; Ojeda is the only suspect in the case, according to MPD and Chief Cunningham. Police: New Bedford woman raped early Saturday at waterfront

NEW BEDFORD — A city man is charged with being part of a group of men who forced a 37-year-old woman into a pickup truck and raped her.
Police arrested Douglas A. Lopez, 29, of 587 S. Second St. after the victim picked him out of a photo lineup Sunday. Police also seized a pickup truck owned by Mr. Lopez.
The victim told police that Mr. Lopez and several other men approached her while she was walking in the area of South Second and Blackmer streets around 2 a.m. Saturday.
She said the men forced her into the truck, drove her to the waterfront and threatened to kill her unless she had sex with them. Court records said the men kicked and punched the victim and tore at her clothes.
Mr. Lopez, who was arrested in February and charged with a home invasion in which he allegedly threatened to kill his wife with a machete, was arraigned Monday in 3rd District Court.
Judge David T. Turcotte revoked Mr. Lopez's bail on the home invasion case Monday, requiring that he be incarcerated until that case is resolved. He set $100,000 cash bail on the new charges.
Court records indicated that Mr. Lopez's previous bail was revoked because of the "horrendous facts" of the new charges against him, the seriousness of his previous case and questions regarding his immigration status.
Mr. Lopez might have immigrated from El Salvador, according to court documents.
He is charged with kidnapping, assault with intent to rape, and assault and battery with a dangerous weapon. He is scheduled to appear in court Friday for a pretrial hearing.
The New Bedford Police Sexual Assault Unit is looking for the other suspects involved. It was not known Monday how many suspects were being sought.
Mr. Lopez was arraigned Feb. 26 on charges of home invasion, assault and threatening, in which he allegedly entered his estranged wife's New Bedford apartment brandishing a machete.
He allegedly held his wife's friend, who was staying in the apartment, by the throat in one hand and held the machete to her throat with the other.
A police report said Mr. Lopez told his wife he would kill her unless she left with him.
Judge Turcotte set a July 27 trial date for Mr. Lopez's home invasion case.

WOODSTOCK – A Huntley man sentenced to 11 years in prison on Tuesday apologized for killing a 48-year-old motorcyclist last year in a drunken-driving crash.“I’m sorry to the family,” Lorenzo Alvarez, 29, said through a Spanish interpreter. “I just want to apologize for the accident.”Alvarez on Tuesday pleaded guilty to aggravated driving under the influence of alcohol, a crime punishable by up to 14 years in prison.In exchange for his guilty plea, prosecutors dropped charges alleging that he fled the scene of the May 21, 2006, accident that killed Jon Fiala, also of Huntley.About 15 of Fiala’s family members watched the court proceedings.“Life [in prison] would have been good, but you got to take what you could get,” Fiala’s ex-wife, Patti Fiala, said of the sentence.Prosecutors said Alvarez had a blood-alcohol content of 0.254 when he was found about three hours after the crash, which is more than three times the legal limit for driving.“[Alvarez] had been drinking at his house, then went to some sort of drinking establishment and had more,” McHenry County State’s Attorney Louis Bianchi said. “I hope it sends a message to the community … that we need to stop losing lives on the highway.”The crash, which happened in the 4600 block of Dean Street in Woodstock, instantly killed Fiala, who was driving a 1980 Harley-Davidson motorcycle. Fatal wreck leads to 15-year sentence

Fort Worth -- A 23-year-old man has been sentenced to 15 years in prison for driving drunk and slamming his pickup into the back of a stopped car, killing a woman, last year.
Lorenzo Aguilar pleaded guilty to intoxication manslaughter several months ago for the August 12, 2006, death of Generosa Edwards. On Friday, state District Judge George Gallagher passed sentence after reviewing an investigation report and hearing from both sides.
Because Aguilar is an illegal immigrant, he will be deported after he serves his time.
"The national events of the day, with border security, were brought home in this case," prosecutor Miles Brissette said "Had this defendant not been in this country illegally, the victim in this case would still be alive today, most likely."
J. Steven Bush, Aguilar's attorney, acknowledged that his client was an illegal immigrant but said he had no criminal record and worked hard to take care of his family.
Bush said intoxication manslaughter cases are very emotional.
"It's a wide range of punishment, from two to 20 years," Bush said.
"Judges have to make the very tough calls. It is not an easy job. That is why Judge Gallagher is the judge -- and I'm a defense lawyer."
Bush and Brissette said they believe that one reason for the 15-year sentence is that Aguilar said he had pulled over because he was realized he was too intoxicated to drive but later got back on the road.
Edwards, 35, was seated in her Ford Mustang about 2 a.m. on the shoulder of southbound Texas 121 at Beach Street, waiting for a friend to arrive to help her change her tire, when Aguilar's Ford F-150 slammed into the back of her car.
Officials said that the Mustang was engulfed in flames and that bystanders could not rescue Edwards. They freed Aguilar after his truck also caught fire.
Edwards had a husband, who is a retired Air Force sergeant, and a young son.
"It was the first Mother's Day without his mom, and it was tough," Brissette said.

Authorities raided the Greenwood Village Trailer Park Tuesday afternoon, and arrested Leida Zapata, Olga Martel-Carrera and Francisco Perez (pictured). The two women are charged with prostitution. Perez faces charges of promoting prostitution. More than one thousand dollars in cash was seized during the raids. Immigration officials have been called in to assist in the investigation.

Man Charged With Attempted Murder of Huntsville Police Officer

Huntsville Police have charged a 23 year old illegal immigrant with attempted murder and resisting arrest.
According to police reports, officers were looking in to suspected drug activity at a home on Jamison Drive late Monday night. One officer approached a car parked in front of the home and attempted to speak with the driver. The driver refused to cooperate, and then put the car in gear. The police report indicates the officer was struck in the leg as the driver fled.
After a brief chase and scuffle with police, Zandoval was taken in to custody. Police Spokesman Wendell Johnson said Zandoval told officers he was an illegal alien from Mexico and was afraid of the police. Johnson also says Zandoval had existing warrants for Driving without a License, Violation of the Mandatory Vehicle Insurance and two Counts of Failure to Appear in Court.

Man who crashed SUV into home identified

A man who bailed out of a moving SUV, leaving it to crash into a Tucson home, has been identified as a Mexican citizen from Ciudad Juarez, Chihuahua, a Pima County sheriff's spokeswoman said.
Hugo A. Estrada, 30, was booked into jail May 15 as "John Doe," Deputy Dawn Barkman said. Charges against him include aggravated assault, endangerment and fleeing from a law enforcement officer. Jail corrections officers were credited in determining Estrada's identity and his residency in the border city just south of El Paso, Texas.
Barkman said Estrada was in the United States illegally. A corrections officer said Estrada is being held without bail, noting an Immigration and Customs Enforcement hold order on him.
Barkman said after the crash that the Chevrolet Suburban Estrada drove had been stolen, but detectives have been unable to confirm who owns it. The plates on the SUV belonged to another vehicle, and the vehicle identification number could not be traced in a state database.
A deputy saw the Suburban go through a stop sign at West Avra Valley and North Trico roads about 3:30 a.m., Barkman said.
When he turned on the emergency lights and siren for a traffic stop, the driver fled, she said.
About six miles away, at West Manville Road near North Coues Deer Lane, the SUV slowed to 5 to 10 mph, and the driver jumped out and ran. The deputy caught him on foot, Barkman said.
The Suburban crashed through a bedroom wall of a home on Coues Deer in which a couple and their 2-year-old daughter were asleep.
The SUV hit a bed, knocking the man and woman to the floor, but no one in the home was injured. The family was not identified.

HOUSTON -- An 18-year-old illegal immigrant denied he committed a string of attacks on females on the city’s north side, though police said his fingerprints were found where two of the crimes occurred.
Edgar San Miguel, who is from Mexico, was arrested May 20 and charged with burglary with intent to commit sexual assault. He was being held in the Harris County jail on $100,000 bail.
In a jailhouse interview with the Houston Chronicle on Saturday, San Miguel denied being the predator who Houston police said is believed to have entered at least 10 homes. In many cases, police said the attacker climbed into bed with girls or women and masturbated while fondling them.
Police lifted San Miguel’s fingerprints from windows at the home where the first attack allegedly occurred on Jan. 13 and from the home of another attack on May 18, said investigator Pedro Moreno of the homicide division’s sex crimes unit.
Three attacks have occurred since San Miguel’s arrest, and appear unrelated to the other incidents, Moreno said. Moreno said San Miguel has refused to answer questions about other cases.
Police have collected DNA samples from some of the incidents and are investigating whether they are connected or might be the work of copycats, Moreno said.
San Miguel admitted in the interview with the newspaper that he broke into the first home, but he said he did not try to assault the 24-year-old woman who lives there.
The woman has identified San Miguel as her attacker.
She said she was awakened that night by a friend who needed a
ride home. When she returned about 2:30 a.m., her attacker jumped out from behind her kitchen table, she said.
The woman said the attacker appeared drunk, spouted vulgarities at her in Spanish and threw her to the floor and onto a coffee table while trying to take off her clothes. After she fought off the attacker and jumped over her couch, he ran away, she said.
The woman said she saw San Miguel on May 20 as he walked along a nearby street. She called police and identified him as the attacker, and he was arrested.

(Central Islip - WABC, May 17, 2007) - Police have arrested two men and are searching for a third accused of raping a Long Island student.
Authorities say the attack happened near the teenage victim's high school in Central Islip, on Carlton Avenue. Now, there are questions about whether the rape was part of a gang initiation.
Long Island reporter Lauren DeFranco has details from Central Islip.
The details of this crime are horrifying. Prosecutors say the victim was grabbed right off the street and gang raped at knifepoint. Police are still searching for a third suspect.
"It really is a shame that it did happen," one student said. "My heart goes out to the girl."
It is a crime that has young women thinking twice about walking alone. Prosecutors describe it as a brutal attack, in which three alleged gang members are accused of abducting a high school girl at knifepoint and simultaneously raping her in a parking lot behind a bar on Carlton Avenue.
"You just got to pray to God and just hope for the best for her," a student said.
"I think that's horrifying, especially for the parents," another said. "Knowing that their child just left the house and then to be attacked."
Police say 26-year-old Leonidas Bonilla grabbed the girl off the street. Now, he and 17-year-old Ariel Memejia are facing multiple charges, including kidnapping, rape and sexual assault.
"The allegations of this crime involve a brutal rape," defense attorney Ed Yule said. "Again, it's an allegation, and it's about as gruesome on paper as it can be."
Investigators say the accused gang members are illegal immigrants from El Salvador. Sources say the men left clothing behind, which led to their arrest. Police are searching for a third suspect, which is leaving high school students nervous about their own safety.
"I'm a walker," one student said. "You don't want to wish that upon nobody. That's the worst thing that can happen to a girl."
Both men are being held on $250,000 cash bail. Anyone with information on the third suspect is urged to call police.

A 38-year-old man convicted of molesting a 12-year-old neighbor was sentenced to 20 years in prison Friday.
Authorities said Adrian Osorto-Aguilera, an illegal immigrant, knocked on the back door of an apartment on Shallowford Road in Chamblee on Dec. 21, 2005, and sexually assaulted the girl who answered the door.
The victim’s 14-year-old cousin later came to the apartment and interrupted the assault.
The cousin identified Osorto-Aguilera, who was arrested the same day. He was found guilty by a DeKalb Superior Court jury Wednesday and received the maximum sentence Friday from Superior Court Judge Robert J. Castellani

A 27-year-old man admitted today in court he abducted and assaulted a 7-year-old neighbor at a Southside apartment complex.

The victim underwent surgery after the attack and remained in Riley Hospital for Children this morning, Indianapolis Metropolitan Police Sgt. Matthew Mount said.
Castillo admitted his guilt, despite the court commissioner's routine entry of a not guilty plea on Castillo's behalf during his initial hearing this morning in Marion Superior Court.
"I agree with what I did, and I know what I did," Jonathan Castillo said through a Spanish translator after Commissioner Steven Rubick read the five charges against him. "I was drunk, and I can't just fix things just because I'm drunk."
Rubick tried to cut him off.
"By confessing under oath, you've just made (the public defender's) job much more difficult," Rubick said.
Prosecutors asked Rubick for Castillo's $100,000 bond to be increased to $250,000, citing the risk to the community and a flight risk because Castillo is an undocumented immigrant. Castillo had told Rubick he is a dual citizen of Mexico and Honduras and works as a day laborer.
Rubick granted the request for higher bond, citing Castillo's "partial confession" as another factor. He is being held in Marion County Jail.
Castillo, police say, wore a mask, climbed through a third-story balcony and snatched the child from her bedroom at the Capital Place Apartments, located near Hanna Avenue and U.S. 31.
He took the victim to his apartment in the same complex and assaulted her, according to police reports.The Star does not generally identify the victims of sexual assault.
The girl’s family discovered her missing about 1:30 a.m. Tuesday and began searching the apartment complex. Family members stepped outside and saw the suspect drop the girl on the ground and run toward another apartment, according to the report.
Another witness, identified as Castillo’s girlfriend, told police she saw the victim’s blood on Castillo’s leg and foot shortly after the assault, according to reports.
Police questioned Castillo and he allegedly admitted to attacking the girl, but reports did not elaborate on any reason for the attack. Police seized a bedspread, clothing, carpeting and other evidence from Castillo’s apartment.
Castillo was charged with burglary and child molesting, both Class A felonies that each carry a potential penalty of 20 to 50 years in prison. He also is charged with two counts of criminal confinement and one count of battery. Both charges are Class B felonies carrying a penalty of six to 20 years in prison upon conviction.
Rubick set Castillo's trial for July 30.
"This is one of those cases you just can't put into words, it's so egregious," said David Wyser, the Marion County prosecutor's chief trial deputy, outside court. "A defenseless 7-year-old girl abducted from her bed."

39 Comments An illegal immigrant from Honduras, who first claimed he was offered sex by a woman in Morristown in exchange for $200, broke down crying Tuesday before admitting to a judge he pulled the victim off a sidewalk and raped her with the help of a passing stranger.
Joel Armando Romero, 28, pleaded guilty before state Superior Court Judge Joseph A. Falcone in Morristown to kidnapping and aggravated sexual assault of the victim on July 10, 2005. The victim has been identified as a young adult from London who was temporarily in the United States working as an intern.
Romero, who recently was given his fifth court-appointed lawyer, chose to affirm in court rather than swear on the Holy Bible. Through a Spanish-speaking interpreter, Romero told the judge: "The Bible is sacred. I don't want to put my hand on the Bible."
The judge led Romero through a lengthy explanation of his plea bargain, and how he will have to register as a convicted sex offender under Megan's Law when he is released from prison, if he is not deported to Honduras.
Morris County Assistant Prosecutor Maggie Calderwood said the state's recommendation for Romero is 30 years in prison, but the judge said he would impose no more than 20 years, with 85 percent of the term to be served before parole eligibility.
Romero -- who said he finished just four elementary school grades in Honduras -- said he was at a bar in town close to 2 a.m. on July 10, 2005, and spotted the woman walking alone on the street as he stood in the tavern doorway. He said he walked with her and struck up a conversation, inquiring "Where's your boyfriend?" He claimed, at first, that the woman solicited him for sex.
"She said she was not looking for a boyfriend. She said she was looking for money," Romero said, prompting Calderwood to rise from her chair in the courtroom.
Romero said the woman told him she would have sex for $200, a statement that caused the judge to halt the proceeding and warn Romero that he was under oath to tell the truth.
Romero bowed his head and started crying, saying: "It's very difficult for me." After conferring for several minutes with defense lawyer William G. Johnson, Romero admitted that he pulled the woman off the sidewalk into nearby woods and raped her.
He said a passing stranger -- later identified as Morristown resident Juan Amendano -- approached him, pulled off the woman's pants and fondled her breasts while he, Romero, forced intercourse on the victim.
"He said he wanted to rape her first," Romero claimed of Amendano. Romero said he assaulted the victim first, before police showed up.
Amendano pleaded guilty in April to aggravated sexual assault, telling the judge he came upon Romero raping the woman in a patch of woods off Lafayette Avenue.
Amendano, who faces eight to 10 years in prison on his plea, said he held the woman down at Romero's request. The woman's cries for help were heard and reported to police, who caught Amendano running away and Romero on top of the victim. Both have been held in the Morris County jail since their arrests.

DENVER — Law enforcement agencies say they followed policies and proceedures, but an illegal alien, accused of sexually assaulting a nine year-old Denver girl, was still able to post a bond and flee the country.
The man, who called himself Manuel Flores, was arrested February 15 and accused of raping and sodomizing his girlfriend’s daughter. According to police documents, he was not able to provide a Social Security number or driver’s license. When he was booked into the Denver Jail, he told Officers he was born in Moralos, Mexico.
A Sheriff’s Department spokesman says they alerted federal immigration officials that Flores might be an illegal alien, but ICE apparently did not put an immigration hold on him. Judge Andrew Armatas set as $35,000 bond, which legal observers say is low for someone suspected of seuxally assaulting a child. But before prosecutors had a chance to argue for a higher bond, Flores put up the $3500 dollars necessary to bond out, and fled to Mexico.
Bounty hunter James Ness discovered Flores real name and tracked him to his hometown in Mexico. Ness says he provided the information to prosecutors, but there is no move to bring the suspect back to the United States. Ness says he thinks this case fell through the cracks, but he adds, “But the crack is huge. A lot of people fall into that crack.”
ICE and the Judge did not respond to Fox31 calls. The Denver Sheriff’s Department says they report roughly 20 suspected illegal aliens under arrest to ICE each day. But the federal agency typically puts holds on only two or three.

Mother Works To Change Immigration Laws

NASHVILLE, Tenn.- A Middle Tennessee woman whose son died in a motor vehicle accident is working to change state laws regarding immigration.
In November 2006, Lyn Tsuji's son, Alex Tsuji died in a car accident.
"We were just shopping for Thanksgiving, and I was buying them video games," Tsuji said.
The family planned to have an all-night video marathon.
As they drove, another driver Mauricio Salazar crashed into their car. Police said he was driving while intoxicated and he was in the Unted States illegally.
She said she thinks about her son all the time.
"Every morning you have to wake up and I have to make peace that I won't be seeing him anymore," she said. "And when I go to sleep, I just hope God is keeping him well."
Refusing to suffer quietly, Tsuji is going public with her private pain. She is pushing for change on Capitol Hill.
"Mr. Salazar has broken and ignored American laws," said Tsuji.
She's furious Salazar was drunk behind the wheel and in this country illegally the day he took Alex away.
To her, what's worse is a plea bargain that would make him eligible in less than three years.
"That is the wrong message," she said. "It just says it's okay, and I don't think that's okay."
Tsuji said that the laws are failing to enforce immigration.
Some lawmakers are listening.
"This is clearly an example of what continues to occur, and will continue, until we start taking some strong measures in our states," said Sen. Bill Ketron, a Republican from Murfreesboro.
State lawmakers are already considering more than 50 new immigration bills this session alone.
Tsuji said she'll be doing her research, making sure Capitol Hill never forgets her story.
"Other countries they have different laws and they are stricter and from where my husband comes from, their laws are very strict about drinking and driving, and their immigration laws are very strict, too," Tsuji said.
Salazar is behind bars in Coffee County. He could be eligible for parole in less than three years.
Ivy Scarborough, the attorney representing the Tsujis, is already representing two other Tennessee families who have lost loved ones in crashes with people who authorities said were driving drunk and living in the United States illegally.

The mother of a 13 year old rape victim says the legal system is bending over backwards to protect the two illegal aliens accused in the crime, at her daughter's expense.
The mother says it's not fair that her daughter has to miss school because defense attorneys demand she appear at routine court hearings. The young girl was required to appear at a motions hearing for 24 year old Eduardo Bocanegro.

The mother says her daughter was traumatized by having to be in the same room as Bocanegro. "Right now, my daughter's in turmoil. She's having a hard time with everything.", Ruth says.
"She just wants it over and now she wishes she didn't come forward and say anything because she feels like she's the one being prosecuted instead of being the victim." Numerous motions mean the case will probably cost the girl a summer vacation to Disneyland and will intrude on her first days of high school. Prosecutors say there's nothing they can do. Ruth says, "Everybody in the court system, they're trying to accomodate these guys that hurt her."
Well, what about accomodating her? What about making sure that it gets done and it gets done accurately and it gets done fast so she can get on with her life."
Bocanegro's trial is currently set for the end of June. The other defendant's trial date has not yet been set, as he is claiming he is incompetent to stand trial.

Kenosha Deputy Fatally Shot During Traffic Stop
Man Arrested After Intense Search

A deputy was shot and killed during a routine traffic stop, and a suspect is in custody after an intense manhunt by land and air, a Kenosha County sheriff's official said Thursday.
Deputy Frank Fabiano Jr. was trying to pull over a red Chevrolet Astro van near the University of Wisconsin-Parkside campus at about 11:37 p.m. Wednesday when he was shot once in the face, according to the Kenosha County Sheriff's Department.
A Parkside police officer serving as a backup radioed that shots had been fired and a deputy was down. He also returned fire, according to the Kenosha County Sheriff's Department.
The shooting happened in an upscale neighborhood on 45th Avenue just south of Highway E.
The gunman disappeared into a wooded area, as dozens of squad cars streamed into the area. A helicopter and police dogs were brought in to search for the male suspect.

Kenosha County Sheriff's spokesman Gil Benn said the 44-year-old suspect was arrested at the Woodcreek Apartment Complex, located about a half-mile from the shooting scene just after 2:30 a.m.

Ezequiel Lopez was hiding behind some cars and was still armed, according to Beth.
He was treated at Kenosha Memorial Hospital for injuries and is in the Racine County Jail.
Beth said the suspect had eight aliases and at least five Social Security numbers. The sheriff said Lopez has a Kenosha address, although it was not known if it is current. Lopez, who was born in Durango, Mexico, has also been arrested several times.
Fabiano was transported to St. Catherine's Hospital, where he pronounced dead. He is survived by his wife and 7-year-old daughter.
Fabiano, an 18-year veteran of the force, received a silver star from the Kenosha County Sheriff's Department for rescuing someone from a burning building in Paddock Lake in 1991. He also received a purple heart in 1991 after getting shot in Paddock Lake.
He graduated from Bradford High School in 1977 and loved to go golfing, Beth said.

KENOSHA - The man now charged with killing Kenosha County Sheriff's Deputy Frank Fabiano is an illegal immigrant with a long criminal record.Despite a criminal record going back six years, Ezeiquiel Lopez was never deported. Only after he was charged with killing Fabiano did anyone try to have him kicked out of the country.Lopez, 44, is accused of murdering the 17-year sheriff's department veteran while high on cocaine. Lopez's history with the law dates back to 2001, when he was arrested in Utah for lewd and lascivious conduct. In 2003, he was arrested in Texas on a gun charge. In 2003, Lopez was picked-up in Missouri for OWI.In 2004, Kenosha Police arrested him on charges of domestic battery, disorderly conduct, bail jumping. Still, this is the first time immigration enforcement had heard of him. "We can find no record of having had contact with this individual before or having had him referred to us by another law enforcement agency," said Tim Counts of Immigration and Customs Enforcement. In court on Friday, Lopez said nothing. But a fellow inmate at the jail says Lopez had plenty to say Thursday night. "He was saying I'll kill another one of you guys, give me a chance and I'll kill another one of you guys." The inmate wanted to remain anonymous. Lopez has a wife and three kids. A criminal complaint says he was angry with his wife, the night of the murder. He admits to drinking tequila, doing cocaine and driving his van. But says he doesn't remember shooting anyone.A judge set Lopez's bond at $1 million Friday. A hearing to determine whether the case should go to trial is scheduled for May 29.

EL PASO, Tx. - Customs and Border Protection agents arrest a convicted child sex offender after trying to cross the border into the US.
CBP Officials tell ABC-7 that 57-year old Ejinardo Barajas-Tinoco was caught on Thursday night by agents using night vision equipment. Officials say Barajas was trying to cross the Rio Grande 6 miles east of the Ysleta Port of Entry.
After detaining him, officials then discovered he had been deported once before after serving 7 years in a Pennsylvania prison after being convicted of 3 sex crimes.
CBP officials say Barajas is in Border Patrol custody. He will be criminally prosecuted and then sent back to Mexico.

NUECES COUNTY, TX - A Nueces County jury reached a guilty verdict at about 5 p.m. in the trial of an illegal immigrant who’s accused of raping an elderly woman in her Annaville home. Testimony wrapped up with emotional appeals to the jury from the prosecution and defense.
The jury deliberated for about two hours after hearing emotional closing arguments from the prosecution, who described the agonizing ordeal the victim lived through - so painful, she thought she thought she was dying.
“Terrible, brutal, vicious, inhuman, you could say these were acts committed by an animal,” Prosecutor Bill Ainsworth said.
Ainsworth described how 22-year-old Eugenio Sandoval brutally raped a 64-year-old woman. The victim sat behind her alleged attacker as Ainsworth tried to convince the jury to find him guilty.
“I don’t think your going to have any doubt or any problem coming to the conclusion, to the poor victim in this case,” he said.
Ainsworth reminded the jury that Sandoval’s skin cells were found on a bra that was used to tie the woman to her bed during the horrific ordeal.
“She was punched in the face; she was urinated on, and was brutally raped,” Ainsworth said. “Every way that someone could be raped.”
Sandoval’s attorney said Sandoval admitted to breaking into the woman’s home, but denied raping the woman, and burglarizing her home. He told the jury that there isn’t enough evidence for a guilty verdict.
Sandoval’s attorney said another man who was with him that night committed the rape.
“I use the word to describe my client as a sacrificial lamb,” Defense attorney Jim Lawrence said. “That’s what we have here.”
But the jury felt Sandoval was guilty on all charges. The punishment phase of the trial begins Thursday. He now faces as much as life in prison.

Mexican charged in traffic death of woman on O'odham land

A Mexican man has been arrested on suspicion of first-degree murder in the traffic death of a woman last month on the Tohono O'odham Nation, a tribal police detective said this morning.
Susan Bieger-Sharkus, 53, was on her way to Rocky Point when she was fatally broadsided by a pickup hauling 1,500 pounds of marijuana, said Detective Marty Fuentes, head of the Tohono O'odham police vehicular offenses detail.
Jose Miguel Ramirez-Soto, 22, of Culiacan, Mexico, was charged with murder under the felony murder law, which allows for such a charge if someone dies during the commission of certain crimes, such as drug smuggling, even if the person charged was not the actual killer.
Bieger-Sharkus had been driving West Ajo Highway around 5:45 p.m. April 27 when the pickup ran the stop sign at the Federal Route 1 intersection and struck her car, Fuentes said.
Ramirez-Soto was a passenger in the truck believed to have been driven by a relative, Fuentes said. The Tucson Citizen is neither naming the driver nor another passenger, both thought to be hiding in Mexico, as they have not been charged in the case. All three men are believed to have been in the United States illegally, Fuentes said.
Though the trio fled the collision, Ramirez-Soto's injuries prevented his getaway.
He was arrested about 3 pm. Tuesday upon release from Maricopa Medical Center in the Phoenix area and taken to Pima County Jail, Fuentes said.
In addition to the murder charge, Ramirez-Soto also has been booked on suspicion of transportation of marijuana and possession of drug paraphernalia, Fuentes said.

A man accused of drunken driving in a crash that killed a University of Maryland sophomore was in the country illegally and carrying a fake Social Security card and a green card purchased in Texas, according to court records filed yesterday.Never L. Navarro-Montoya was driving an acquaintance's blue Ford Ranger without a driver's license when he hit an oncoming Jeep Cherokee that was making a left turn from University Boulevard to Metzerott Road in College Park about 3:30 a.m. Saturday, killing 20-year-old Matthew Watson of Ellicott City, according to police.
It was unclear from police reports which driver had the right of way at the intersection.Prince George's County police charged Narravo-Montoya, 24, of Greenbelt, with driving under the influence of alcohol, fleeing the scene of an accident and possession of false government identification, according to court records. Navarro-Montoya told police he was from Mexico.Watson, who attended the College Park campus, was a front-seat passenger in the Jeep. He graduated in 2005 from Centennial High School, where he was a lineman on the football team and played saxophone in the band.This was the second time in less than six months that an undocumented immigrant has been charged in a fatal accident involving a Howard County resident.In November, Eduardo Raul Morales-Soriano, a Laurel landscaper from Mexico, was charged with vehicular homicide and drunken driving in a Thanksgiving night crash at Routes 175 and 108 that killed a Columbia Marine home on leave and his date from Montgomery County.Morales-Soriano is awaiting trial in Howard County Circuit Court, after having registered a 0.32 blood-alcohol level on a Breathalyzer - four times the legal limit, court records say.In the most recent crash, the charging documents state that a witness watched Navarro-Montoya jump out of the Ranger after the crash and flee on foot. About four hours later, passers-by found Navarro-Montoya lying on the grass off of University Boulevard about one-third of a mile from the scene and called police.Cpl. S. Ainsworth of the Prince George's County police detected a strong odor of alcohol on Navarro-Montoya's breath and arrested him. Investigators were awaiting the results of a blood test taken at Washington Adventist Hospital, where Navarro-Montoya was treated for cuts to the left side of his head."He didn't have a driver's license from Maryland or any other state," said Cpl. Diane Richardson, a spokeswoman for the Prince George's County Police Department.Police said two other occupants of the Jeep, which rolled over, were treated at a hospital for injuries not considered life-threatening. "That's so mischievous," his mother, Barbara Watson, said as one of her younger sons retold the story. "Of course, I'm sure they knew whose car it was because he was in the band. He loved to play in the jazz band. He loved music."His friend, Alex Blatter, now a sophomore at Pennsylvania State University, said that in addition to stalling marching band practice, Watson once arrived at school wearing six or seven polo shirts - one on top another - as a parody of some of the preppier students at Centennial."A lot of kids would come wearing [two polo shirts] at our school," said Blatter, who knew Watson since fourth grade. "It was one of the funniest things I've ever seen."His football coach, Jamie Wagner, said that he had heard that Watson had a smart sense of humor, but added that he never saw that side of him. He said Watson took football "very seriously," describing him as a model student-athlete and teammate."He kind of fit into every social group in the school," Wagner said. "He wasn't in one particular [clique]. He just fit in with everybody. As a football coach, it's important to have a person with that kind of character on your team because he can build bridges between different groups."

Watson's team lost every game during his senior year except the last one - the first time the team played at home under the lights.As students stormed the field, Watson, a lineman, ripped out a piece of turf and later planted it in a terracotta pot that sits on the patio beside his family's pool. His parents plan to tend to the turf now, almost as a mini-memorial to their son, the oldest of five children.
Barbara Watson said that the team's victory in its last game was "an incredibly memorable moment" for her son."Being a lineman, it's not a glamorous position by any stretch of the imagination," the coach said. "He did the job, he did it well, and he did it quietly. Drunk driving is suspected in crash that killed woman

MARYLAND HEIGHTS — A suspected drunken driver was charged Saturday with involuntary manslaughter after his car plowed into the back of another vehicle, killing a young woman.The suspect, Pedro Santos, 27, was arrested about 3 a.m. Saturday, about three hours after the crash, hiding in woods not far from the scene at Marine Avenue and Bennington Place.Killed in the crash was Nicole Allen, 21. She was a back-seat passenger in an Acura that had slowed or just stopped at the intersection, waiting for a green light, about midnight Friday. A Lincoln Town Car slammed into the back of the Acura.Allen died at the scene. The Acura's driver, Larry Lane, 24, suffered minor injuries. His front-seat passenger, Charles Miller, 28, had two cracked vertebrae. Both remained hospitalized Saturday at St. John's Mercy Medical Center in Creve Coeur.
Police say that Santos' vehicle was disabled by the crash and that he ran from the scene. Authorities used a helicopter and search dogs to find him. Police say they think Santos had been the only person in the Lincoln.Three hours after the crash, Santos appeared intoxicated, police said. Santos' blood was drawn, but results of his blood-alcohol level aren't yet available, said Maryland Heights police Sgt. Mark Pruett.Prosecutors in St. Louis County charged Santos with involuntary manslaughter, two counts of second-degree assault by driving while intoxicated and leaving the scene of an accident. Bail was set at $100,000.Santos admitted to police that he had entered the country from Mexico illegally. His local address was in the 12300 block of Bennington Place. Police say he was a restaurant cook.Allen lived with her mother, Denise Buchholz, and stepfather, Brian Buchholz, in the 11800 block of Gold Leaf Drive, an unincorporated pocket of St. Louis County near Maryland Heights.Allen graduated in 2004 from Parkway North High School. She worked as a server at Red Robin restaurant and was a junior at the University of Missouri-St. Louis, studying photography, graphic design and art history."She was a cute, petite, fun-loving friend," said her aunt Debbie Nolen of Springfield, Mo. "She was a little angel."The fact that Santos is an illegal immigrant was not lost on Allen's family, who gathered at the home on Gold Leaf. That further enraged them."He had no business being on the road anyway, but he's drunk on top of it," Nolen said. Some of her friends plan to set up a fund for memorial contributions at Citizens Bank in Florissant, said Allen's stepfather. The money may be used for a scholarship for art students.

Driver Gets Max Sentence In Crash That Killed Officer

TAMPA - To Jose Luis Espinoza, the death of city police Detective Juan Serrano last year was just an accident.
To Judge Ronald Ficarrotta, the accident was a horrible crime.
Ficarrotta on Tuesday sentenced Espinoza to 30 years in prison, the maximum. Espinoza was convicted in January of driving-under-the-influence manslaughter for the February 2006 car crash that killed Serrano, who was Mayor Pam Iorio's bodyguard and driver.
"I'm really sorry for what happened," Espinoza, 36, an illegal Mexican immigrant, said through an interpreter before he was sentenced.
"I'm very sorry. I'm not a bad person. I don't have a record. I've never done anything like this. … We all make mistakes. Nobody's perfect."
Espinoza drove a 1996 Pontiac that crushed the city-issue Ford Taurus Serrano drove that day after driving Iorio home from the Gasparilla Distance Classic.
"This was a tragic, tragic accident," the judge said Tuesday. But this accident was a crime, he told Espinoza, pointing out that he was intoxicated, chose to drive and fled after the crash.
"Everyone in this courtroom makes mistakes," the judge said. "To characterize your actions that day in February as a mistake is to grossly underestimate it. You committed a crime. You took the life of another human being … who by all accounts was an outstanding police officer, an outstanding family man, an outstanding human being."
Assistant State Attorney Kim Seace said Espinoza's apology was worthless. She said Espinoza was given an opportunity to show remorse when interviewed for his presentence report and instead invented a new story, claiming he was a backseat passenger in the car that hit Serrano's.
"He has no remorse, and this apology today, I think, is an empty one," Seace said, asking Ficarrotta to impose the maximum sentence.
Serrano's widow, Mylin Matos Serrano, told Ficarrotta her husband was important to a lot of people.
"My husband's watch ended tragically on Feb. 25, 2006, as he made his way home to the family he loved, after doing the job he loved," she said. "He will be forever missed. The void in my life will never be filled."
Juan Serrano protected foreign dignitaries visiting Tampa, infiltrated drug-trafficking organizations and helped start the department's gang-suppression unit. Serrano worked as a police officer in Puerto Rico for several years before joining the Tampa police in 1989.
After the hearing, Mylin Serrano was asked whether she accepted Espinoza's apology or agreed with the prosecutor that it was not sincere. A little bit of both, she said.
"I'm pretty sure he had time to remorse," she said. "I can't judge him, but he might be remorse, and I hope he was."
Police Chief Stephen Hogue attended the hearing and later said, "It's kind of a sad day, but by the same token, I think justice was serviced." Hogue said he came to court to represent law enforcement and be there for Serrano's family.
"We also lost a family member of our own," he said.

He also belonged to the Tampa community. He was first and always a police officer, and I knew and understood that. He was completely dedicated to the job that he loved and was so proud of. William purchased the Lucky Seafood Market in December 2005 in an attempt to financially support the family and his ministry. He came home every night with stories of the different people he met and sang to. He had intended to raise funds to serve in Henan Province, China, where his heart was touched by the suffering caused by the high rate of HIV infection and AIDS related deaths among people too poor for treatment.

"On the night of the murder, our family was celebrating my youngest brother’s 10 th birthday. At around 8:45pm , my father informed us and the guests that he was going to go close up the store. Leon Lugo Andradé, a man with a history of violence, had a protective order against him for over a year for regularly beating his wife and children throughout their relationship. Just in Houston alone, Andradé has a long criminal record starting with a murder/manslaughter 15 years, continuing with numerous DWI’s, firing a weapon and carrying a shotgun in a public place. When the wife finally left him, he became increasingly threatening, forcing his ex-wife and children to move every few months."

Andrade finally located his wife and followed her to the Huang household where she and her children had fled for protection. Reverand Huang distracted Andrade from his wife and children and Andrade finally chased Reverand Huang around a car with a machete, hacking him to death.

"Eventually, my father fell. Andradé forced him into the alley next to the restaurant and struck him with multiple blows to the head. My father attempted to defend himself by putting up his arms to block the machete, and received large gashes on his hand and forearm and losing his thumb. The right side of his face had been split open in 3 places. The back of his skull had been shattered leaving a gaping hole in the back of his head. Andradé immediately drove off in his green van when witnesses started to show up after hearing the screams from the women. My father’s actions bought enough time to save the life of the woman and her daughter. "

llegal Alien Arrested In Connection With Fatal Hit And Run

A man is now under arrest in connection with the hit and run that killed a 14-year-old boy in Bucks County.Police said Carlos Reyes, 37, is an illegal alien.
The accident happened on Sunday night on Street Road at Kingston Way in Bensalem.
Reyes entered district court Monday night in Bristol borough.
Police said he ran down 14-year-old Rasheen Newkirk, then took off.
The teenager was run over by a second vehicle, but that driver stopped.
The family said Rasheen was a special needs child, who was going to the store at the time of the accident.
"He loves school. He loves to sing. He just love to dance," Rasheen's aunt Sharon Newkirk said.
Police found Reyes' car early Monday morning in Bensalem.
They said he bent the license plate to elude authorities, because he did not have a driver's license.
"He is very sorry of the accident. He really feels bad about the family. He doesn't know what to do," translator Esthella Forget said.
"He is remorseful. He's afraid understandably so," Officer Tim Clark said.
A preliminary hearing is set for Dec. 7.
Bail was first set at $100,000, but was increased to $500,000 after Reyes couldn't remember where he lives.

An illegal alien previously arrested on a domestic dispute but not deported is accused of shooting dead three men outside a bar in Altoona, Pa., after telling police he had been experiencing blackouts.
Miguell A. Padilla, 25, called police after the shooting and said he "believed he had hurt somebody but had been having blackouts," the Blair Country district attorney said yesterday.
He was caught shortly after Sunday's shooting and charged with three counts each of criminal homicide, aggravated assault and recklessly endangering another person, as well as one count of illegal possession of a handgun. He was ordered held without bail.
Police and city officials in Altoona believe the case may be the first-ever triple homicide in the central Pennsylvania town of 50,000, located about 85 miles east of Pittsburgh.
The shooting occurred just before 2 a.m. Sunday after Padilla and two companions tried to enter the bar in the United Veterans Association Club in downtown Altoona, a 69-year-old institution known as a regular site for wedding receptions and reunions.
After Padilla was told the bar was members-only – a sign saying just that was posted in the window – he got into an argument, first, with the club's doorman, Frederick Rickabaugh, 58, and then with the club's owner, Alfred Mignogna, 61, both of Altoona. Padilla returned to his car, came back with a handgun and shot Rickabaugh and then Mignogna, police said.
Another shot hit Stephen Heiss, 28, a bar patron and state prison guard, who was entering the club with a female friend when he saw Padilla shooting and pushed his friend out of the way.
Mignogna, a longtime Altoona High School math teacher who also owned another bar in town, died at the scene. Rickabaugh and Heiss died later at Altoona Regional Health Systems hospital.
After he fled the scene to a home in Altoona, Padilla called 911 and said he knew police were looking for him, authorities said.
"He said he believed he had hurt somebody but had been having blackouts and maybe had some flashbacks about it," said Blair County District Attorney Dave Gorman.
A year ago, Altoona Police arrested Padilla during a domestic dispute and Cooper said the department discovered that he was an illegal immigrant from Mexico. Cooper said he didn't know why Padilla wasn't deported after that.
"For the answer to that question, you'll have to call" U.S. Immigration and Customs Enforcement, which handles illegal immigration deportation, Cooper told the local paper. "They were notified."

Charges Filed In Wreck That Killed Ex-Coach
16-Year-Old Charged With Involuntary Manslaughter

KANSAS CITY, Mo. -- Wyandotte County, Kan., prosecutors filed charges Wednesday in a wreck that killed a former football coach at Olathe North High School.
David K. Bassore, 51, of Liberty, was driving home from work Monday on Interstate 35 near the 18th Street Expressway exit when his pickup truck was clipped by a Dodge Neon. Bassore's pickup went off the road, rolling twice before it stopped on its side. Bassore was thrown from the vehicle. He died at the scene.
Prosecutors charged the driver of the Neon, 16-year-old Raul Cabrera, of Shawnee, Kan., with one count of involuntary manslaughter in juvenile court.
Officials said Cabrera is an illegal immigrant, and the judge decided the teen should remain in custody.
The Kansas Highway Patrol is still investigating the fatal wreck, but they suspect Cabrera was drag racing with another car.
KMBC's Maria Antonia reported that Cabrera's mother said her son was not racing; he was being chased by another driver and that he had been followed for several days.
Officials said they are considering charging Cabrera as an adult or upping the charge to second-degree murder.

Vigil Held For Coach

Bassore had recently resigned from his coaching position at Olathe after being at the school a year.Wednesday night, Olathe students held a vigil for their former coach.
"He'd probably say, 'What are you guys crying over me for? I want you guys to be positive and happy,'" football player Jarod Milo said.
"Really made you feel at home, at school, and made it a fun thing and brought a smile to everybody," student Kim Burnell said. "We just want to get people involved and let them know who he was and if they didn't know him, let them know what a great person he was."
"He loved every player on his team and we loved him back," football player Raymond Due said.
